Analysis
This resolution approves Host Worksite Agreements and Addenda between the Department of Public Works and Milwaukee Area Workforce Investment Board, Inc., and between the Department of Public Works and United Migrant Opportunity Services, Inc., for an initiative to use 75 MAWIB or UMOS transitional program participants to perform City infrastructure maintenance activities for up to 1,040 hours per participant, with MAWIB and UMOS as the employers-of-record and DPW as the host worksite.  It further authorizes the Commissioner of Public Works to enter into the Host Worksite Agreements and Addenda with MAWIB and UMOS and to expend the funds necessary to carry out this initiative.

Whereas, The Wisconsin Department of Children and Families has awarded funding from the Temporary Assistance for Needy Families program to the Milwaukee Area Workforce Investment Board ("MAWIB") and United Migrant Opportunity Services ("UMOS") for these agencies to assist unemployed parents and low-income workers in transitioning into the workforce through subsidized employment; and
 
Whereas, MAWIB and UMOS match transitional jobs program participants with "host" businesses that provide work opportunities and training; and
 
Whereas, Participants are employees of MAWIB or UMOS and are placed in assignments for periods not to exceed 1,040 hours; and
 
Whereas, MAWIB or UMOS is the employer-of-record and, consequently, responsible for all employment-related requirements, such as fulfilling I-9 requirements, collecting payroll taxes and IRS reporting; and
 
Whereas, On April 22, 2014, the Common Council adopted File Number 131797, a resolution approving a Host Worksite Agreement between the City and UMOS for an initiative to use 25 UMOS transitional jobs program participants to perform City street maintenance activities for up to 1,040 hours each, with UMOS as the employer-of- record and the Department of Public Works ("DPW") as the host worksite; and
 
Whereas, On May 13, 2014, the Common Council adopted File Number 131714, a resolution relating to the use and allocation of Community Development Block Grant ("CDBG") 2014 reprogramming funds; and
 
Whereas, File Number 131714 approved the awarding of $283,500 in CDBG reprogramming funds for a MAWIB/UMOS transitional jobs initiative; and
 
Whereas, DPW has determined that this $283,500 will support an additional 75 transitional job assignments, with both MAWIB and UMOS as employers-of-record and DPW serving as the host worksite providing job experience, skills acquisition, and meaningful and much-needed employment; and
 
Whereas, As indicated in the attached May 2, 2014, letter from Mayor Barrett's Office to Alderman Joe Davis, Sr., DPW has identified several City service areas where the work of DPW employees could be supplemented by the use of 75 additional MAWIB and UMOS transitional jobs program participants; and
 
Whereas, According to the U.S. Bureau of Labor Statistics, in January, 2014, the City of Milwaukee's official unemployment rate was 9.4%, compared to 6.9% for the Milwaukee metropolitan area; and
Whereas, The unemployment rate in some Milwaukee neighborhoods and among certain subsets of the city's population far exceeds the 9.4% figure; and
Whereas, The Mayor and Common Council are committed to implementing innovative solutions to both improving the maintenance of the City's infrastructure and reducing Milwaukee's unemployment rate; and
Whereas, The Mayor and Common Council find that the creation and implementation of job-training and employment opportunities in the DPW service areas identified in the May 2 letter would address both the City's infrastructure-maintenance needs and its unemployment problems; and
Whereas, The attached Host Worksite Agreements and Addendums (together constituting Exhibit A) document the provisions and requirements of this initiative between the City and MAWIB and between the City and UMOS; and
Whereas, The Host Worksite Agreements allow the host worksite to supplement the program participant wage beyond the $7.25 per hour wage rate paid by MAWIB or UMOS as the participant's employer-of-record; and
Whereas, The City's estimated costs of using 75 MAWIB and UMOS program participants to perform various DPW activities for the City for up to 1,040 hours per participant are shown in Exhibit B; and
Whereas, The qualifications and requirements for participation in this transitional jobs program are set forth in Exhibit C; and
Whereas, Participants in the UMOS transitional jobs program must reside in the area bounded by Silver Spring Drive, Mitchell Street, Interstate 43 and Sherman Boulevard (Exhibit D); and
Whereas, The Host Worksite Agreements require that no employee of the host worksite be displaced or have his or her hours reduced due to use of program participants by the host worksite; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Host Worksite Agreements in their original form and the corresponding Addenda, as shown in Exhibit A, are approved to implement an initiative between the Department of Public Works and the Milwaukee Area Workforce Investment Board, Inc., and between the Department of Public Works and United Migrant Opportunity Services, Inc., to place 75 MAWIB or UMOS program participants within DPW to perform various infrastructure maintenance activities for up to 1,040 hours per participant, with MAWIB and UMOS as the employers-of-record and DPW as the host worksite; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to enter into Host Worksite Agreements and Addenda with MAWIB and UMOS in substantially the same form as the documents in Exhibit A; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to expend the necessary funds to implement the initiative set forth in this resolution.
