(Expires 7/14/2014) The applicant has met with his security team to discuss how to fix problems. The bar uses ID scanners and has a book of banned patrons. He has spoken with the alderman and Police Department regarding issues. He also developed a plan of action with the Police Department. Security personnel has taken a course to learn to de-escalate situations. He has also updated lighting outside and increased security cameras. Minutes note: 07 WILLIAMS, Lorri A, Food Dealer -Restaurant Renewal Application for "Ms. Mae's Good and Tasty/Money Lounge" at 5209 W Hampton Av. (Expires 6/30/2014) The applicant states she wants the establishment to be a full restaurant, but she has encountered issues with renovations. The current business operation was not her intention and she has had issues at the establishment. The business had limited food at the beginning and has been open 8 am until midnight. Attorneys have advised her to have more than just one on one meetings with police. She apologizes to residents in the area. She has taken wrong advice and has not been able to get the establishment running the way that it should be. She did not realize the problems had gotten so bad and would like an opportunity to improve the neighborhood. Ald. Wade states that he visited the establishment at various times during the day and it was never open. He has only observed activity at night time. He states he is concerned about all of the activities that have occurred at what is supposed to be a restaurant. Individuals appearing:Assistant City Atty Nick Desiato Captain Jackson - He states a lot of crime has occurred at the location in a short period of time. There have been issues with juveniles and a lack of communication with the applicant. He has sent officers to the premise numerous times and called the applicant at phone numbers listed on her application with no response. This meeting is the first time he has seen the applicant. Officer Brian Kobelinski - Milwaukee Police Department, District 7 - He has tried to contact the applicant after each police incident. He has gone to her home, emailed her, called her, and could not get a response. He has not seen the establishment open between 8 am and midnight. Officer Michael Valluch - Milwaukee Police Department, District 7 - On July 19, 2013, he responded to a shots fired complaint. Upon arrival, he saw multiple juveniles exiting the establishment and also observed them loitering outside. On December 28, 2013 a call was received for a juvenile party. Upon arrival, he received resistance from the door man. After entry, he observed a DJ playing and 3-5 people gambling with dice. There was also an odor of burning marijuana. He states that she does not have Public Entertainment Premises license. Karen Grady - Milwaukee Health Department - On May 28, 2013, she released a hold on the Food Dealer license application with restrictions. The establishment's hood was condemned for safety reason. The applicant was given authorization to serve cold food, but hot food had to be catered in. After the preinspection, she did a routine inspection and observed the establishment was serving food on June 18. She was unable to gain access after that date, despite several attempts. She also left three notices on the door and left a message on the business Facebook page. She called the applicant's house several times as well. She later witnessed a for-sale sign on the lot and requested that the business be designated as out of business on September 19. The applicant notified the License Division to state she was not out of business and Ms. Grady was then able to reach the applicant by phone. Gwendoline Allen - 4731 N 52nd St - She has lived in the neighborhood for 37 years and has recently had to live through all the criminal incidents on the police report. She has been woken up by gunfire. Customers from the establishment park on her street, drive quickly, block driveways, and hang out vehicle windows. She has observed bullet casings outside the door of the establishment. She rarely sees the owner during the day, but occassionally sees her in the parking lot cleaning. She states the previous business was not a problem and they were good neighbors. Sharon Hansen - 5123 W Courtland Ave- She agrees with the previous speaker. She has been awoken by gunshots and did not have the same problems in previous years prior to the business opening. Randy Hansen - 5123 W Courtland Ave - He agrees with previous speakers. Ald. Meeting reconvened at 4:04 PM The applicant states they have tailored the hours to suggestions from some neighbors. They will have 200 mugs available with a deposit. Individuals cannot use their own mugs. Individuals appearing in opposition: Dani Graf - 2914 S Pine Ave - She states that the proposal is unsafe and unnecessary. Cars crowd around the nearby intersection. A playground is nearby and children are present every day. There is also not a designated parking area. Noise may also become an issue. The beer garden would be adjacent to the pavillion which is rented out for individual events. This could cause problems. She states that she has seen a flyer where a free appetizer was offered in exchange for support. Lenore Burger - 2902 S Pine Ave - She has expressed concerns since February. The music and traffic will affect the neighborhood. Crowding is already an issue in the park. She is also concerned with the large capacity and not having a plan for capacity control. Children and pets could run into the excessive traffic. Parking is a concern as well. She states the park is very busy and there is not room for the beer garden. Susan Millar - 308 E Rosedale - She states the park is used heavily by children and states those spaces should not be replaced with a place for adults to drink alcohol. Traffic will become an issue. Kurt Schwenke - 2927 S Lenox - There are already problems with people parking in the crosswalks. He states that adding 200 more people to an already crowded, unsafe area is a bad idea. He is also concerned with noise from the beer garden. He can already hear music from parties at the park pavillion if his windows are open and thinks the beer garden will increase noise. Jose Navidad - 2904 S Pine Ave - He believes having a bar across the street from his home will lower the house value. He is concerned that the applicant does not have a good plan to keep crowds under capacity and is worried that litter will become an issue. Individuals appearing in support: Libby Dianne Flynn - 815 E Ohio - She is new to the area and is excited about the proposed beer garden. She states the applicant has compromised on some issues that she was previously concerned with. The applicant has adjusted plans for the location within the park based on neighborhood suggestions. She states that the current pavillion does not have ADA accessible restrooms, but the applicant will bring in accessible restrooms. County Supervisor Jason Haas - 3442 S Pennsylvania Ave - He states that the applicant was the sole respondent to the RFP for Humboldt Park. He has been taking questions and comments from neighbors and working directly with the applicant. They have repeatedly worked with objectors. The beer garden will not be open during school hours. The applicant is making improvements to the infrastructure and thinks there will be an improvement in people coming to the park. He states that the County Board could not vote on the contract. He thinks the beer garden will help with the overall safety of the park. Vandalism may be reduced because more individuals are present to view the park. There will be a big effort to pick up litter. John Dargle - Parks Director - 5774 N Kent Ave, Whitefish Bay - The RFP that was released was very general about offering food and beverage throughout the parks system. A nonalcoholic proposal could have been submitted. Signage is used to keep individuals with alcoholic beverages within the licensed premise. It is also self-managed. Tim Richter - 442 E Fremont Pl - Humboldt Park Watch - They think the beer garden will help improve safety in the park. Routine maintenance from the applicant would help prevent vandalism. The beer garden at Estabrook Park has improved the park and they hope to see a similar improvement at Humboldt Park. The vote at the last meeting had zero votes in opposition. He states that aside from events at the park, he does not believe that it is overly populated. Paul Smith - 2440 S Quincy - He states he believes the applicant is concerned with safety and will address the concerns. Jane LaCapatain - 2728 S Quincy Ave - The beer garden will bring more people to the park, providing extra pairs of eyes to keep the area safe. She states that there is parking available, so it should not become an issue. Ald. Puente moved to make pictures of the playground submitted by Ms. Millar as part of the record - Exhibit #1. He has increased lighting and cameras based on police recommendations. He often works at the bar, but is able to view camera footage from his phone and can go to the bar if he sees issues arising. The establishment closes at 1:00 during the week and 1:30 on the weekends, but has a 15 minute cool-off period to allow patrons to slowly leave the establishment. He has removed some speakers and turns music down before closing. He states that men standing outside the establishment that neighbors have seen are security guards. Ald. He states the bar has always been a nuisance. Janelle Holcomb - 7155 N 44th St - She states the establishment has transformed from a quieter establishment with noise three nights per week to a busy bar with loud noise six nights per week. She has had to call 911 after hearing shots fired. She has also heard screaming and sirens from outside the establishment. Loitering outside of the establishment is also a concern. Ald. Puente states he has met with the applicant and police and made suggestions to the applicant. He also made an agreement for the applicant to close an hour earlier. Instead of allowing customers to slowly leave after the closing time, he suggests the applicant close earlier, still allowing a 15 minute cool-off period. Previous attempts from the applicant to deal with noise have not been successful, as he is still receiving noise complaints from neighbors. Ald.
