Substitute resolution approving a Host Worksite Agreement and Addendum between the Department of Public Works and United Migrant Opportunity Services, Inc., relating to transitional job opportunities and street maintenance activities.
Analysis
This resolution approves a Host Worksite Agreement and Addendum between the Department of Public Works and United Migrant Opportunity Services, Inc., for an initiative to use 25 UMOS transitional program participants to perform City street maintenance activities for up to six months, with UMOS as the employer of record and DPW as the host worksite.  It further authorizes the Commissioner of Public Works to enter into the Host Worksite Agreement and Addendum with UMOS and to expend the funds necessary to carry out this initiative.

Whereas, The winter of 2013-2014, Milwaukee's 10th coldest on record, included 28 consecutive days of below-freezing temperatures, tying the winter of 1917-1918 for the ninth-longest stretch of below-freezing days; and
Whereas, The extreme weather conditions of the winter of 2013-2014 have negatively affected the condition of Milwaukee streets and have increased the need for street repairs by the City of Milwaukee Department of Public Works ("DPW"); and
Whereas,  The increased need for City street repairs is reflected in the fact that in the first quarter of 2014, the City's Call Center (286-CITY) received 4,101 requests for pothole repairs, a 29% increase from the same period in 2013; and
 
Whereas, DPW has determined that, in addition to its regular complement of street maintenance crews authorized by the 2014 City Budget,  25 street laborers would improve DPW's ability to respond to the increased need for repairs to City streets; and
Whereas, According to the Bureau of Labor Statistics, in January, 2014, the City of Milwaukee's official unemployment rate was 9.4%, compared to 6.9% for the Milwaukee metropolitan area as a whole; and
Whereas, The unemployment rate in some Milwaukee neighborhoods and among certain subsets of the city's population far exceeds the 9.4% figure; and
Whereas, The Mayor and Common Council are committed to implementing innovative solutions to both improving the condition of the City's streets and reducing Milwaukee's unemployment rate; and
Whereas, The Mayor and Common Council find that the creation and implementation of job-training and employment opportunities in the area of street maintenance and repair would address both the street-condition and unemployment problems; and
Whereas, United Migrant Opportunity Services, Inc. ("UMOS"), a Milwaukee-based agency, offers transitional employment services that provide work experience, job skills and career counseling to individuals having difficulty entering and succeeding in the workplace; and
Whereas, Under this program, UMOS serves as the program participants' employer of record, placing participants with host worksites for a period not to exceed 1,040 hours; and
Whereas, The attached Host Worksite Agreement and Addendum (together constituting Exhibit A) document the provisions and requirements of this initiative; and
Whereas, The Host Worksite Agreement allows the host worksite to supplement the program participant wage beyond the $7.25 per hour wage rate paid by UMOS as the participant's employer of record; and
Whereas, The City's estimated costs of using 25 UMOS program participants to perform street maintenance activities for the City for a period of six months are shown in Exhibit B; and
Whereas, The qualifications and requirements for participation in this transitional jobs program are set forth in Exhibit C; and
Whereas, Participants in the UMOS transitional jobs program must reside in the area bounded by Silver Spring Drive, Mitchell Street, Interstate 43 and Sherman Boulevard (Exhibit D); and
Whereas, The Host Worksite Agreement requires that no employee of the host worksite be displaced or have his or her hours reduced due to use of program participants by the host worksite; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Host Worksite Agreement in its original form and the corresponding Addendum, as shown in Exhibit A, are approved to implement an initiative between the Department of Public Works and United Migrant Opportunity Services, Inc., to place 25 UMOS program participants within DPW to perform City street maintenance activities for up to six months, with UMOS as the employer of record and DPW as the host worksite; and, be it
 
Further Resolved, That the Commissioner of Public Works is directed to prepare, and submit to this Common Council file, a revised Exhibit B that reflects a program participant wage rate of $10.10 per hour or the current living wage, as set forth in s. 310-13 of the Milwaukee Code of Ordinances, whichever is higher; and, be it
 
Further Resolved, That this revised Exhibit B shall supersede all other Exhibit B documents in this Common Council file; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to enter into a Host Worksite Agreement and Addendum with UMOS in substantially the same form as the documents in Exhibit A; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to expend the necessary funds to implement the initiative set forth in this resolution.
