Title
Substitute resolution authorizing the Commissioner of Public Works to execute a contract with Resource Recovery Systems, LLC, doing business as ReCommunity, for the construction and operation of a Material Recovery Facility (MRF) in partnership with Waukesha County, and establishing an Equipment Reserve Fund.
Analysis
This resolution authorizes the Commissioner of Public Works to execute a contract with Resource Recovery Systems, LLC, doing business as Recommunity, for the reconstruction and operation of a Material Resource Facility in partnership with Waukesha County.
 
The resolution also directs the City Comptroller to establish an Equipment Reserve Fund as set forth in the intergovernmental cooperation agreement.
Body:
Whereas, The City of Milwaukee  and Waukesha County each owns a Material Recovery Facility (MRF) that historically has been operated under private contract, and has processed similar annual quantities of recyclables; and
 
Whereas, The existing processing systems in both the City of Milwaukee's MRF and Waukesha County's MRF have reached or exceeded their useful design life; and
 
Whereas, Between 2007 and 2012, a series of studies were completed by both the City of Milwaukee and Waukesha County to determine the best path for future MRF updates or alternative arrangements as needed to adopt to changing recycling collection and processing systems; and
 
Whereas, Due to a number of program efficiency advantages that single-stream recycling has over dual-stream recycling, the above-noted studies have strongly recommended that both the City of Milwaukee and Waukesha County implement a single-stream recycling system; and
 
Whereas, The Recycling Task Force, commissioned by the Common Council in 2009, recommended in its final report to implement single-stream collection and processing of recyclables and to investigate in detail using the City's MRF building as either a transfer station or a regional single-stream MRF; and
 
Whereas, The above-noted studies suggest significant economies of scale through joint processing of recyclables from the City of Milwaukee and Waukesha County; and
 
Whereas, Common Council Resolution File Number 121495, adopted February 27, 2013, approved an intergovernmental cooperation agreement between the City of Milwaukee and Waukesha County to jointly issue a request for proposals for recycling services; and
 
Whereas, Pursuant to the joint City of Milwaukee/Waukesha County Request for Proposal (RFP) Official Notice #118-2013, including Addenda 1 to 5, and its Proposal, Resource Recovery Systems, LLC, (ReCommunity) was selected to construct, operate and maintain the MRF; and
 
Whereas, Pursuant to the RFP, ReCommunity was selected based on its skill, expertise and successful experience with similar projects, including operating a publicly-owned MRF, maintaining the quality of marketable recovered materials, successful marketing of commodities, and ensuring openness and accountability with public funding; and
 
Whereas, The construction of the Joint MRF is being implemented with financial support from Waukesha County via the intergovernmental cooperation agreement; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves an intergovernmental cooperation agreement with ReCommunity in substantially the same form as is attached to this file, and authorizes the Commissioner of Public Works to execute the contract on behalf of the City; and be it

Further Resolved, That the City Comptroller is directed to establish an Equipment Reserve Fund as set forth in the intergovernmental cooperative agreement; and, be it
 
Further Resolved, That the City Comptroller and other City officials are directed to take whatever steps are necessary to fulfill the intent of this resolution.
