Title
Resolution relative to acceptance and funding of an Urban Nonpoint Source and Stormwater construction grant from the State of Wisconsin, Department of Natural Resources for the construction of bioswales in the medians of South 27th Street from West Howard Avenue to West Oklahoma Avenue.
 
Analysis
This resolution authorizes the Department of Public Works, Infrastructure Services Division to accept and fund an Urban Nonpoint Source and Stormwater construction grant from the Department of Natural Resources in the amount of $169,000 with a City of Milwaukee share of $84,500 and a 50% grantor share of $84,500 up to a maximum grantor share of $100,000. The grant allows the City to construct bioswales on South 27th Street between West Howard Avenue and West Oklahoma Avenue.
 
Body
Whereas, Stormwater pollution control is an important component of the City's storm water management regulation and the City's stormwater discharge permit with the Department of Natural Resources (DNR); and
 
Whereas, Roadways are one of the primary sources of non-point source pollution by discharging polluted runoff directly into the local streams and water bodies, threatening public health and natural habitat and species; and
 
Whereas, The City, as part of a street reconstruction project of South 27th Street between West Howard Avenue and West Oklahoma Avenue, is proposing to construct bioswales in the median areas of the street; and
 
Whereas, Bioswales, which  are landscaped areas with special soil, are an established and cost effective means of removing sediment from public streets by infiltrating and treating stormwater runoff before it enters the City's storm sewer system; and
 
Whereas, The South 27th Street reconstruction project is located within the municipal separate storm sewer system portion of the City; and
 
Whereas, This project will demonstrate how highly urbanized areas can be designed to provide direct environmental benefits and be aesthetically integrated into the urban streetscape; and
 
Whereas, The DNR has awarded the City with 50% matching grant funds, not to exceed $100,000 to construct the bioswales; and
 
Whereas, The operation of this grant begins on January 1, 2014 and ends on December 31, 2015 and is estimated to cost approximately $169,000, of which, $84,500 would be provided by the City and 50% grantor match of $84,500 up to a maximum grantor share of $100,000 would be provided by the DNR; and
 
Whereas, Department of Public Works/Infrastructure Services has committed funds for the entire cost of the project (SM493130104) per common council file Number 130687; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the City Engineer is hereby authorized to accept such a grant without further Common Council approval unless the terms of the grant change as indicated in Common Council file 030712 (Grant Ordinance); and, be it
 
Further Resolved, That upon approval of this contract, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project; and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater as follows:

Further Resolved, That these funds are appropriated to the Department of Public Works, Infrastructure Services Division which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
 
Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
 
Further Resolved, That the Commissioner of Public Works on behalf of the City of Milwaukee be authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts
