Analysis
This resolution authorizes the Department of Public Works, Infrastructure Services Division to apply, accept and fund a Milwaukee Metropolitan Sewerage District (MMSD) Green Infrastructure Partnership Program grant in the amount of $200,000 with a City of Milwaukee share of $100,000 and a grantor share of $100,000. The purpose of the grant is to install green infrastructures such as bioswales and permeable pavements to help reduce as well as treat stormwater runoff. The bioswales will be installed in the terrace areas of and the permeable pavement will be installed in the parking lanes of East Greenfield Avenue between the Chicago & North Western Railway  right of way and the Kinnickinnic River. This resolution also authorizes the Commissioner of Public Works to execute a Green Infrastructure Funding Agreement between the City and MMSD.
 
Body
Whereas, Stormwater pollution control is an important component of the City's storm water management regulation and the City's stormwater discharge permit with the Department of Natural Resources; and
 
Whereas, Roadways are one of the primary sources of non-point source pollution by discharging polluted runoff directly into the local streams and water bodies, threatening public health and natural habitat and species; and
 
Whereas, This project will incorporate bioswales and permeable pavers, which are an established means of reducing stormwater volume and of removing sediment from public streets before it enters the City's storm sewer system; and
 
Whereas, The bioswales and the permeable pavers will be constructed as part of an overall street reconstruction project of East Greenfield Avenue from South First Street to the Kinnickinnic River; and
 
Whereas, The project will demonstrate how highly urbanized areas can be designed to provide direct environmental benefits and be aesthetically integrated into the urban streetscape; and
 
Whereas, The City is has applied for Green Infrastructure Partnership Program grant funding from the Milwaukee Metropolitan Sewerage District (MMSD) for the installation of bioswales in the terrace areas of and permeable pavements in the parking lanes of East Greenfield Avenue; and
 
Whereas, MMSD has accepted the City's application and has awarded the City with a grant of $100,000; and
 
Whereas, The operation of the grant is effective from the date of execution of the Funding Agreement through December, 2015 and is estimated to cost $200,000, of which $100,000 would be provided by the City and $100,000 would be provided by the MMSD; and
 
Whereas, Department of Public Works has committed funds for the entire cost of the project (SM493130103) per common council file Number 121679; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to accept and execute such a grant without further Common Council approval unless the terms of the grant change as indicated in Common Council file 030712 (Grant Ordinance); and, be it
 
Further Resolved, That upon approval of this Agreement, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project; and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater as follows:

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to accept and execute the Green Infrastructure Funding Agreement between the City and the MMSD, a copy of which is attached hereto; and, be it
 
Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
 
Further Resolved, That the Commissioner of Public Works on behalf of the City of Milwaukee be authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
