Substitute resolution Approving Cooperation Agreement for Summerfest Access, in the 4th Aldermanic District.

Analysis

This Resolution approves a Cooperation Agreement by and among the City, acting through its Board of Harbor Commissioners, Discovery World Limited, Milwaukee World Festivals, Inc., the State of Wisconsin Department of Natural Resources and Milwaukee County.  Under this Agreement a new Summerfest North Gate vehicular access for equipment and supply vehicles will be constructed on an easement granted by the City, acting through its Board of Harbor Commissioners.  World Festivals will release its interest to an access roadway as specified in the Conservation Easement from the City to the Wisconsin Department of Natural Resources. The release of this easement interest will reduce the vehicular traffic in and about the Discovery World facility.  North Harbor Drive between East Michigan Avenue and East Chicago Street will also be widened to the west over land granted to the City under a County of Milwaukee Easement.  The City will continue to maintain North Harbor Drive after the widening and World Festival will maintain the adjacent new sidewalk.  This street widening will greatly improve vehicular flow in or around the Summerfest grounds and enhance both vehicular and pedestrian safety.  Discovery World will contract and pay for all costs associated with the design and construction of both the North Gate Access and North Harbor Drive widening projects.  World Festival may contribute toward the costs of those projects.  Finally, the Board of Harbor Commissioners and the City will formalize World Festival’s limited right to use South Urban Park by granting World Festival a license to use the park under the direction of the Board of Harbor Commissioners.

Body

Whereas, The City and Discovery World, Ltd. entered into an October 11, 2003, Development and Lease Agreement for the construction and operation of the Discovery World facility, (the “Discovery World Lease”); and

 

Whereas, The City and Milwaukee World Festivals, Inc. entered into a January 1, 2001, Lease Agreement for the operation, use and maintenance of the Summerfest Grounds (the “Festivals Lease”); and

 

Whereas, The City and State of Wisconsin Department of Natural Resources entered into a February 1, 2003, Cooperation and Development Agreement for the development of the Lake Shore State Park (the “Park Agreement”); and

 

Whereas, The parties hereto desire to enter into this Cooperation Agreement to facilitate the access to and operation of their various facilities located on the Discovery World Site, SummerFest Site, Lake Shore State Park Site and South Urban Park Site; and

 

Whereas, The Board of Harbor Commissioners has approved the Cooperation Agreement; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Cooperation Agreement for Summerfest Access attached to this file is hereby approved and the proper City officers are hereby authorized to execute said Agreement; and, be it

 

Further Resolved, That the City Attorney may make minor nonsubstantive changes to the Agreement prior to its execution and that the Commissioner of Public Works is authorized to provide any City approvals required under the Agreement.
