Analysis
This resolution effectuates a provision of the 2014 Adopted Budget to create a Special Purpose Account in the Department of Administration to issue a request for proposal to perform a compliance audit of the Small Business Enterprise Program. The Department of Administration is directed to issue a request for proposal to conduct a compliance audit of the Small Business Enterprise Program.
Body
Whereas, By amendment to the 2014 Adopted Budget, the Common Council directed the creation of a Special Purpose Account R146 in the General Fund of the Department of Administration to be funded with $40,000 to perform a compliance audit of the Small Business Enterprise Program; and
Whereas, Common Council Resolution File Number 130180, adopted June 11, 2013, authorized settlement of Hispanic Chamber of Commerce of Wisconsin, et al. v. City of Milwaukee v. D Wilson Consulting Group LLC, et al.; and
Whereas, The settlement agreement provided for continued suspension and repeal of ss. 370-15-1-a and b and 370-21-1 and 2 of the Code which established participation goals for women and minority businesses contracting with City departments; and
Whereas, The Common Council wishes to determine whether the Small Business Enterprise Program is meeting its intended purpose of assisting and protecting the interests of small business concerns in order to promote and encourage full and open competition in the City; and
Whereas, The Housing and Redevelopment Authorities have agreed to provide funds and participate in a compliance audit; and
Whereas, Adoption of appropriate legislation is necessary to effectuate the intent of the amendment; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, The Department of Administration is directed to issue a request for proposal to conduct a compliance audit of the Small Business Enterprise Program; and, be it
Further Resolved, The compliance audit shall include:
1. Investigation and evaluation of the Small Business Enterprise Program as administered by the City as well as the Housing and Redevelopment Authorities.
2. Participation of small businesses in City-funded construction projects and contract procurement.
3. Identification of barriers or impediments to inclusion of small business in City-funded construction projects and contract procurement.

Further Resolved, The compliance audit shall identify actions for the City to maximize inclusive participation in the areas of economic development for small businesses; and, be it
Further Resolved, The Compliance audit shall review the administrative application of equal access and opportunity laws, policies and rules; and, be it
Further Resolved, That the City Comptroller is directed to establish all accounts and accounting procedures necessary to fulfill the intent of this resolution.
