Analysis

Current code provisions prohibit any person from improperly accosting, ogling, insulting, following, pursuing, laying hands on or otherwise molesting any person of the opposite sex theretofore to him or her unacquainted.  This ordinance expands the existing provisions by prohibiting any person from committing such acts against any person of the opposite or same sex.  In addition, the ordinance increases the maximum penalty for violating these provisions from $250 to $500.  In lieu of paying a forfeiture, the violator may be ordered to perform community service work, in accordance with s. 800.09, Wis. Stats.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 106-11 of the code is repealed and recreated to read:

 

106-11.  Mashing Prohibited.  Any person who shall improperly accost, ogle, insult, follow, pursue, lay hands on or otherwise molest another person theretofore to him or her unacquainted, shall upon conviction forfeit no more than $500, or in default of payment may be imprisoned in the house of correction of Milwaukee county for not more than 20 days, or until the fine and costs are paid.  In lieu of paying a forfeiture, any person violating this section may be ordered to perform community service work, in accordance with s. 800.09, Wis. Stats.
