Substitute resolution amending a special privilege for change of ownership to BV Prospect 1, LLC for three non-code compliant hoods for the premises at 2217-2239 North Prospect Avenue.
Body
Whereas, Prospect Mall Limited Partnership requested permission to install and maintain three non-code compliant hoods in the public right-of-way; and

Whereas, Permission for said hoods was granted in 1995 under Common Council Resolution File Number 941961; and

Whereas, BV Prospect 1, LLC now owns the property; and

Whereas, For the liability to be formally transferred to the current property owner, the Common Council needs to adopt an amending resolution; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that Common Council Resolution File Number 941961 is hereby rescinded; and, be it

Further Resolved, That BV Prospect 1, LLC, 311 East Chicago St., Suite 210, Milwaukee, WI 53202 is hereby granted the following special privileges:

1. To keep and maintain an existing entrance façade structure (hood) on the westerly side of North Prospect Avenue. Said façade encroaches approximately 1 foot into the west 18-foot wide sidewalk area for a distance of 21 feet 6 inches and is centered approximately 176 feet south of the southline of East Ivanhoe Place. Said encroachment provides at least 9 feet 6 inches of vertical clearance from the sidewalk grade. Connection to the building sewer to drain the roof is waived.

2. To keep and maintain an existing entrance façade structure (hood) on the westerly side of North Prospect Avenue. Said façade encroaches approximately 5 inches into the west 18-foot wide sidewalk area for a distance of approximately 8 ...
