Title

Resolution authorizing in-rem foreclosure of properties at 2835 W. Kilbourn Avenue, 2841 W. Highland Boulevard and 2809 W. Highland Boulevard.

This resolution directs the City Treasurer to begin in-rem foreclosure against properties at 2835 W. Kilbourn Avenue, 2841 W. Highland Boulevard and 2809 W. Highland Boulevard under the “Internal Protocol for Community Improvement In-Rem Foreclosure Actions” established by the City Attorney’s Office.

Body

Whereas, The “Internal Protocol for Community Improvement In-Rem Foreclosure Actions” established by the City Attorney’s Office, pursuant to Common Council file number 030680, provides that if a property is a nuisance or otherwise a blighting influence, and City ownership of and control of the parcel will mitigate or ameliorate the nuisance or blight, the Common Council may authorize the acquisition of the property through in-rem foreclosure action; and

 

Whereas, The property at 2835 W. Kilbourn Avenue has numerous nuisance and code enforcement violations that have gone unabated by the property owner, including lack of heat, defective toilets and roach and mice infestation; and

 

Whereas, Moreover the property at 2835 W. Kilbourn Avenue also owes taxes to the City of Milwaukee totaling $71,568.97 for the years 2006 and 2007; and

 

Whereas, The property at 2841 W. Highland Boulevard has numerous nuisance and code enforcement violations that have gone unabated by the property owner, including lack of heat, leaking and water damage and mice infestation; and

 

Whereas, Moreover the property at 2841 W. Highland Boulevard also owes taxes to the City of Milwaukee totaling $101,952.00 for the years 2006 and 2007; and

 

Whereas, The property at 2809 W. Highland Boulevard has numerous nuisance and code enforcement violations that have gone unabated by the property owner, including lack of heat, defective electricity and rat, mice and roach infestation; and

 

Whereas, Moreover the property at 2809 W. Highland Boulevard also owes taxes to the City of Milwaukee totaling $59,816.07 for the years 2006 and 2007; and

 

Whereas, The City is willing to use in-rem foreclosure in these matters in an effort to foster community improvement through nuisance abatement and to return these tax-delinquent properties to the tax rolls; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the City Treasurer is authorized and directed to bring in-rem foreclosure actions against the eligible tax-delinquent properties at 2835 W. Kilbourn Avenue, 2841 W. Highland Boulevard and 2809 W. Highland Boulevard.
