Analysis
This resolution rescinds special privileges granted to Norlight Telecommunications Inc. that are no longer necessary because Norlight Telecommunications is now a registered utility with the Public Service Commission of Wisconsin.
Body
Whereas, Norlight Telecommunications Inc. applied for and was granted special privileges for various encroachments in the public right-of-way; and

Whereas, At the time the special privileges were granted, Norlight Telecommunications Inc. had not registered as a utility with the Public Service Commission of Wisconsin; and

Whereas, Norlight Telecommunications Inc. has never contested the special privileges nor has it notified the Department of Public Works of its status as a registered utility with the Public Service Commission of Wisconsin; and

Whereas, Research performed by Department of Public Works staff revealed that Norlight Telecommunications Inc. is registered with the Public Service Commission of Wisconsin; and

Whereas, Utilities registered with the Public Service Commission of Wisconsin are permitted to keep and maintain facilities within the public right-of-way per State Statutes; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the following special privilege resolutions are rescinded:

1. Common Council Resolution File Number 990656 granted in 2006 for fiber optic cable systems routing in the 1st, 3rd, 6th, 9th, and 15th Aldermanic Districts.

2. Common Council Resolution File Number 050390 granted in 2006 for a manhole, underground conduit and fiber optic cables located in East Mason Street between North Broadway and North Milwaukee Street.

3. Common Council Resolution File Number 050535 in 2006 for fiber optic cable, duct, and associated facilities in the 4th and 12th Aldermani...
