Title

An ordinance relating to conditions for issuance of certificates of occupancy.

Analysis

Currently, the code provides that whenever the proposed use of a building, structure or premises is not in the same group of uses as the prior use and is as hazardous or more hazardous than the prior use, or the proposed use is an elementary or secondary school, tavern or sit-down restaurant, the commissioner of city development shall issue a certificate of occupancy only:

 

1.  After an application for a certificate of occupancy has been filed with the commissioner by the owner, agent or tenant.

 

2.  After city inspection staff finds that the building, structure or premises complies with all applicable code provisions.

 

This ordinance changes the second of these 2 conditions to read as follows:

 

After an inspection or reinspection of the building, structure, premises or part thereof by the commissioner of neighborhood services finds no violations of the regulations of this code applicable to the proposed use.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 200-42-3-a-2 of the code is repealed and recreated to read:

 

200-42.  Certificate of Occupancy.

 

3.  WHEN ISSUED.

 

a-2.  After an inspection or reinspection of the building, structure, premises or part thereof by the commissioner of neighborhood services finds no violations of the regulations of this code applicable to the proposed use.
