Analysis
This resolution authorizes the release of the City’s interest in an Easement on an adjacent property.
Body
Whereas, In 1991, the City of Milwaukee (“City”) acquired a parcel at 1426 West Center Street (“City Parcel”) that was the beneficiary of an Easement (“Easement”) created on March 8, 1946, that provided the owner of the City parcel with access to a walkway running across the adjacent parcel at 1422 West Center Street (“Burdened Parcel”); and
Whereas, The Easement no longer affords any benefit to the City Parcel, which is now a vacant lot; and
Whereas, Consideration to the City for release of the Easement consists of removal of an encroaching fence from the City Parcel and delivery to the City of a release from both the former owner and current owner of the Burdened Parcel; and
Whereas, The City will incur no cost in connection with the release of Easement; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the release of the Easement is approved and that the proper City officials are directed to execute such release of Easement conditioned, upon receipt of a release from the former and current owners of the Burdened Parcel and removal of the encroaching fence from the City Parcel.
