Title

Resolution authorizing the Milwaukee Police Department to execute relocation agreements with Cricket Communications and T-Mobile to surrender certain frequencies within the 2.1 GHz band in exchange for the provision of a replacement system.

Analysis

This resolution authorizes the Chief of Police to execute relocation agreements with Cricket Communications and T-Mobile that outline the terms and conditions under which the MPD will surrender certain frequencies within the 2.1 GHz band in exchange for replacement equipment and services provided by Cricket Communications and T-Mobile.

Body

Whereas, The Milwaukee Police Department (MPD) currently operates a microwave radio system on certain frequencies within the 2.1 GHz band; and

Whereas, The Federal Communication Commission (FCC) in ET Docket No. 00-258 has reallocated and auctioned these frequencies to commercial enterprises for emerging technologies known as Advanced Wireless Services; and

Whereas, The FCC has mandated that these commercial enterprises provide MPD with comparable interconnection service at no cost; and

Whereas, The MPD is negotiating relocation agreements with Cricket and T-Mobile whereby the MPD will receive equipment and technical training to enable it to utilize the City’s Fiber Optic System; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Chief of Police is hereby authorized to execute Relocation Agreements attached to this file; and, be it

Further Resolved, That the authority hereby granted to the Chief includes the authority to negotiate and make reasonable modifications to the agreements that do not change the intent of this Resolution.
