Title
Substuitute Resolution relative to a Guaranteed Energy Savings Performance Contract for energy system upgrades to the Milwaukee Safety Academy Building controls and equipment and upgrade of traffic signals to utilize light emitting diode indications.
Analysis
A Committee appointed pursuant to Common Council File Number 060153 for the review of proposals submitted to the City for a Guaranteed Energy Savings Performance Contract has recommended the selection and acceptance of a proposal submitted by Johnson Controls, Inc., which may lead to the award of a performance contract. This Resolution accepts the recommendation of the Committee, and authorizes the Commissioner of Public Works to direct Johnson Controls to complete an energy audit of building systems and equipment at the Milwaukee Safety Academy, an audit of Light Emitting Diode signal indications on a portion of the City’s signal system, and to determine a scope of improvement work and financial terms for a guaranteed energy savings performance contract. Upon successful completion of the audit and development of an acceptable scope of services, guarantees and financial terms consistent with requirements of Section 66.0133 of Wisconsin State Statutes, this resolution also authorizes negotiation and development of a guaranteed energy savings performance contract only if all terms and conditions are agreed upon, and which will require subsequent approval and final award by the Common Council.

Whereas, The Department of Public Works issued a Request for Proposals for energy conservation improvement measures at the Milwaukee Safety Academy and a portion of the City’s traffic signal system as directed by the Common Council of the City of Milwaukee under Resolution File Number 060153 adopted on June 20, 2006; and
Whereas, Proposals were received in response to the Request for Proposals from Johnson Controls, Inc. and Honeywell International; and
Whereas, A Review Committee appointed by the President of the Common Council to review and evaluate these proposals has recommended the selection of the proposal submitted by Johnson Controls, Inc; and
Whereas, A first phase energy audit of building systems and equipment at the Milwaukee Safety Academy and of the conversion of traffic signal indications to energy saving Light Emitting Diode (LED) indications on portions of the City’s traffic signal system is to be performed for the City by Johnson Controls at no cost to the City upon acceptance of their proposal in order to define the extent of improvement measures to be implemented to achieve energy and other cost savings; and
Whereas, The energy audit is anticipated to define and produce an estimate of all costs associated with the design, installation, operation, repairs, maintenance and financing of recommended energy conservation and improvement measures which may be implemented by Johnson Controls, Inc.; and
Whereas, Successful completion of the energy audit will define a series of recommended energy conservation and facility improvements to be implemented by Johnson Controls, Inc. where anticipated implementation costs for the City is not likely to exceed the amount to be saved in energy and operating costs, consistent with all requirements of Section 66.0133 of Wisconsin State Statutes, over the remaining useful life of the facilities to which these improvements are made; and
Whereas, The energy audit will determine minimum guaranteed quantities and amounts by which energy or operating costs will be reduced through implementation of the energy conservation and improvement measures to be implemented; and
Whereas, Upon successful completion of the energy audit and full agreement as to project scope and financial terms, an energy savings performance contract will be negotiated for implementation and financing of recommended energy conservation and improvement measures; and
Whereas, Final award of this Energy Savings Performance Contract can be made by the Common Council of the City of Milwaukee in accordance and consistent with all requirements of Section 66.0133 of Wisconsin State Statutes only upon further Common Council action; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proposal submitted by Johnson Controls, Inc. in response to the Request for Proposals for a Guaranteed Energy Savings Performance Contract authorized under Common Council Resolution File Number 060153 is hereby accepted, as recommended by the Review Committee, to pursue a performance contract for energy system upgrades to the Milwaukee Safety Academy Building controls and equipment, and/or the upgrade of a portion of the City’s traffic signal system through installation of LED signal indications; and, be it
Further Resolved, That the Commissioner of Public Works is hereby authorized to direct Johnson Controls to begin a first phase energy audit of building systems and equipment at the Milwaukee Safety Academy and a selected portion of the City’s traffic signal system at no cost to the City to: 1.) define a series of improvement measures to be implemented to achieve energy savings; 2.) to define and produce an estimate of all costs associated with the design, installation, operation, repairs, maintenance and financing of recommended energy conservation and improvement measures where anticipated implementation costs for the City are not likely to exceed the amount to be saved in energy and operation costs over the remaining useful life of the facilities to which these improvements are made; and 3.) to determine a minimum guaranteed amount by which energy or operating costs will be reduced through implementation of the recommended energy conservation and improvement measures; and, be it
Further Resolved, That only upon satisfactory completion of the energy audit and final agreement as to the complete scope of work, financial terms and conditions for implementation of recommended energy and cost savings improvements, the Department of Public Works is hereby authorized to begin negotiation and development of an energy savings performance contract, to be awarded by the Common Council of the City of Milwaukee only upon further Common Council review and action.
