Analysis
This ordinance establishes that applicants for public passenger vehicles drivers’ licenses for the operation of handicapped and elderly vehicles are required to take the same city geography and public passenger vehicle regulation tests currently established by the city clerk and administered by the police department for all other public passenger vehicle applicants. Currently, certain applicants for public passenger vehicles drivers’ licenses for the operation of handicapped and elderly vehicles are permitted to be tested by their prospective employers through certain in-house programs that have been approved by the chief of police.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 100-54-2-d-1 of the code is renumbered 100-54-2-d.

Part 2. Section 100-54-2-d-2 of the code is repealed.

(Note: The provision being repealed reads as follows:
100-54. Driver’s License.
2. QUALIFICATIONS AND APPLICATIONS.
d-2. Drivers of handicapped-elderly vehicles shall have successfully completed a program approved by the chief of police with respect to the requirements of par. e or complied with testing provisions in par. e.)

Part 3. Section 100-54-2-e of the code is amended to read:
e. Be able to read, write and speak the English language to the extent necessary to operate a public service vehicle licensed by the city. In order to satisfy this requirement, applicants must pass a test established by the city clerk >>and administered by the police department<< regarding knowledge of city streets, major buildings, facilities and city regulations regarding public passenger vehicles.
