Title
Substitute resolution directing the Intergovernmental Relations Division - Department of Administration to seek introduction of state legislation relating to recommendations of the Fireworks Task Force.
Analysis
This resolution directs the Intergovernmental Relations Division - Department of Administration to seek introduction and passage of state legislation that enacts the following recommendations of the Fireworks Task Force:

1. Prohibition of possession and use of fireworks statewide.

2. Elimination of the potential for misinterpretation and inappropriate application of state law for permitting possession of fireworks anywhere within the state pursuant to a permit granted by the state or by any local jurisdiction.

3. Establishment of a penalty for fireworks violations, and establishment of jurisdiction for enforcement to the district attorney of the county where a violation of the law occurs.
Body
Whereas, The City of Milwaukee Fireworks Task Force was created by Common Council File Number 060529 on September 26, 2006, to evaluate and make recommendations relating to decreasing the prevalence of fireworks in the City of Milwaukee; and

Whereas, The Task Force held 7 public meetings, beginning on January 11, 2007, and submitted its Final Report and Recommendations to the Common Council under File Number 061200, a communication relative to the findings of the Fireworks Task Force; and

Whereas, Certain recommendations require enactment of state legislation; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Common Council directs the Intergovernmental Relations Division - Department of Administration to seek introduction and passage of state legislation that enacts the following recommendations of the Fireworks Task Force:

1. Prohibition of possession and use of fireworks statewide.
