Alderman Zielinski asked whether the Fire & Police Commission or the Police Chief has statutory authority to make a decision in an instance where the two entities can't come to an agreement? Mr. Tobin responded that according to the Wis., Stat., 62.50(3), the Fire & Police Commission has the governing oversight authority. Alderman Zielinski requested that Mr. Tobin provide a formal legal opinion regarding this matter prior to the October 23, 2007 Common Council meeting. Alderman Hamilton asked Mr. Tobin how he would address many of the current situations in the police department including citizen complaints against police officers?
