Resolution authorizing the Commissioner of Public Works to execute right-of-way documents required for the improvement of North 76th Street between West Calumet Road and West County Line Road.
Analysis
This resolution authorizes the Commissioner of Public Works to execute right-of-way documents associated with Project I.D. 2140-08-73; North 76th Street (STH 181) between West Calumet Road and West County Line Road. These documents convey rights associated with water and sewer easements owned by the City of Milwaukee. There are no associated costs to the City of Milwaukee as part of these proceedings.
Body
Whereas, The Wisconsin Department of Transportation (WISDOT) has programmed the improvement of North 76th Street (STH 181) from West Calumet Road to West County Line Road; and

Whereas, Common Council File No. 050156, adopted on June 24, 2005, authorized the Commissioner of Public Works to execute the most-recent revision to the project agreement between the City of Milwaukee and WISDOT for the subject project; and

Whereas, Preliminary engineering undertaken by the WISDOT’s design consultant, Strand Associates, Inc., for the subject project, has indicated the necessity to acquire land interests currently held by the City of Milwaukee as part of water and sewer easements to facilitate construction; and

Whereas, The WISDOT has drafted and is requesting our execution of the necessary documents which will convey both temporary and permanent rights associated with said easements; and

Whereas, The Department of Public Works, with the assistance of the City Attorney’s Office, negotiated the documents with WISDOT, to assure that the City’s sewer and water facilities may remain in the subject land area undisturbed; and

Whereas, There are no costs to the City of Milwaukee as part of these proceedings; now, therefore, be it
