Analysis

Resolution authorizes settlement of the lawsuit, Wisconsin Community Service and Wisconsin Community Foundation, Inc. without payment of any City funds.

 

Body

Whereas, The Wisconsin Community Service and Wisconsin Community Foundation, Inc. have filed a lawsuit against the City of Milwaukee, Case No. 01-C-575, seeking an unspecified amount of damages and attorney’s fees; and

 

Whereas, The plaintiffs have agreed to settle this lawsuit without the payment of any money in damages or attorney’s fees; and

 

Whereas, The City has agreed to request that appropriate steps be taken by the Redevelopment Authority of the City of Milwaukee in an effort to arrange bond financing to refinance the mortgage on the premises occupied by the plaintiffs at North 37th Street and West Wisconsin Avenue; and

 

Whereas, The City of Milwaukee has further agreed to indicate to the Board of Zoning Appeals for the City of Milwaukee that the City has no objection to the Board’s renewal of the special use permit for the aforementioned mental health clinic at the aforementioned location; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the proper City Officers be and are hereby authorized to assist the plaintiffs in their effort to obtain bond financing to refinance the aforementioned mortgage; and, be it

 

Further Resolved, That the City hereby expresses no objection to the Board of Zoning Appeals of the City Attorney of Milwaukee to the renewal of a special use permit for the mental health clinic at the aforementioned location with those limitations and terms typically employed by the Board of Zoning Appeals for such occupancies.
