Body
Whereas, Milwaukee Boston Store Co., Division of Federated Department Stores, Inc. requested permission to keep and maintain an underground conduit in the public right-of-way; and

Whereas, Permission for said underground conduit was granted in 1955 under Common Council File Number 45499-b; and

Whereas, Carson Pirie Scott, Inc. is now responsible entity for the underground conduit; and

Whereas, For the liability to be formally transferred to the current property owner, the Common Council needs to adopt an amending resolution; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that Common Council File Number 45499-b is hereby rescinded; and, be it

Further Resolved, That Carson Pirie Scott, Inc., c/o Judy Goggins, 331 West Wisconsin Avenue, Milwaukee, WI 53203, is hereby granted the following special privilege:

To keep and maintain a 4-inch diameter underground conduit crossing the 70-foot wide right-of-way of North 4th Street between 615 North 4th Street and 331 West Wisconsin Avenue. Said conduit crosses North 4th Street at a point approximately 75 feet north of the northline of West Michigan Street.

Said above-mentioned underground conduit shall be used, kept and maintained to the satisfaction of the Commissioners of Public Works and Department of Neighborhood Services.
