Title
A substitute ordinance relating to ice cream peddlers.

Analysis
Currently, no person may operate as an ice cream peddler without first having obtained an ice cream peddler license. This ordinance amends the ice cream peddler license requirements by exempting individuals to obtain an ice cream peddler license if all retail sales are conducted at a temporary event as defined in s. 60-23-1, provided that average daily attendance is estimated at 5,000 persons or more.
Body
Whereas, The Milwaukee Code of Ordinances requires the licensing of ice cream peddlers, in that ice cream peddlers have substantial contact with children; and make frequent stops when operating an ice cream vending vehicle; and

Whereas, At a temporary event an ice cream peddler is less likely to have unobserved contact with children; and

Whereas, At temporary events of 5,000 persons or more there is much less opportunity for inappropriate behavior between ice cream peddlers and children based on the level of supervision at such temporary events; and

Whereas, An ice cream peddler working at a fixed location at a temporary event is much less likely to cause a traffic disturbance; now, therefore

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 74-2-3 of the code is amended to read:

74-2. Ice Cream Peddler License.

3. LICENSE REQUIRED. No person shall operate or act as an ice cream peddler within the city without first having obtained an ice cream peddler license. The ice cream peddler license required by this section shall be in addition to the food peddler permit required in s. 74-1.>>No ice cream peddler license shall be required if all retail sales are conducted at a temporary event as defined in s. 60-23-1, provided that average daily attendance is estimated at 5,000 persons or more.<<
