Title

Resolution authorizing the construction of streetscape improvements on West Wisconsin Avenue from the Milwaukee River to North 2nd street in the 4th Aldermanic District under the Federal Congestion Mitigation/Air Quality Program, at a total estimated cost of $2,600,000 of which 80% or $2,080,000 is State funded and 20% or $520,000 is City Funded.

Analysis

This resolution authorizes the construction of streetscape improvements on the segment of West Wisconsin Avenue from the Milwaukee River to North 2nd Street.  Funding for this project will primarily be provided through the Wisconsin Department of Transportation under a Federal Congestion Mitigation/Air Quality Program Grant for the development of primary pedestrian corridors in the Milwaukee Central Business District.  The total estimated cost is $2,600,000, of which 80%, or $2,080,000 is State funded and 20% or $520,000 is City Funded. This resolution also authorizes the Comptroller to establish and transfer funds to the appropriate accounts for the project.  The total estimated cost of the project (Phase V) is $6,250,000 with grantor funds of $5,000,000 and City funds of $1,250,000.  The total estimated cost of Grants I, II and III is $24,053,197.50, with a grantor share of $19,226,558 and a city share of $4,806,639.50.

Body

Whereas, The Wisconsin Department of Transportation (WISDOT) has approved funding of a project under the federal Congestion Mitigation/Air Quality (CMAQ) program for the development of primary pedestrian corridors in the Milwaukee Central Business District to promote walking as an alternative means of transportation in the Milwaukee Central Business District (CBD); and

 

Whereas, Common Council Resolution File Number 981733, File Number 990806, File Number 021033, File Number 040147, and File Number 060921 authorized the Commissioner of Public Works and the Comptroller to execute agreements for the programming and construction of pedestrian friendly improvements on East/West Wisconsin Avenue, North Water Street and East/West Kilbourn Avenue under the CMAQ Program to undertake preliminary engineering for this pedestrian corridor development project; and

 

Whereas, The streetscape improvements have been completed or are currently under way on West Wisconsin Avenue from North 2nd Street to North 4th Street, West Wisconsin Avenue from North 4th Street to North 10th Street, and East Wisconsin Avenue from the Milwaukee River to the intersection of East Mason Street and North Prospect Avenue; and

 

Whereas, The total estimated cost for this element of Phase V construction is $2,600,000; and

 

Whereas, The project agreement for Phase V of the Milwaukee CBD Primary Pedestrian Corridors Development Project provided funding for three separate work elements including improvements to continue the implementation of the primary pedestrian corridors, to expand the pedestrian wayfinding system into other portions of the downtown area, and to provide pedestrian facility improvements on North 5th Street to link the new Multimodal Transit Station with the Downtown Primary Pedestrian Corridors; and

 

Whereas, This first project element would complete the development of the primary East/West pedestrian corridor through the Downtown Area through the implementation of streetscape improvements on the last unimproved section of West Wisconsin Avenue from the Milwaukee River to North 2nd Street; and

 

Whereas, Eighty percent of the participating project cost, or $2,080,000, is reimbursable from WISDOT, and this amount is not included in Division accounts, and should be earmarked for this project in the 2007 Capital Grant and Aids Projects Fund Project/Grant Number SP032070100; and

 

Whereas, Twenty percent of the participating costs, or $520,000, is non-reimbursable and is included in the Division’s 2007 Capital Purpose Project /Grant Number ST320070000; and

 

Whereas, WISDOT cannot proceed with any project cost overruns and/or changes in scope of more than five percent without prior Department of Public Works approval; and

 

Whereas, After successful completion of existing elements, remaining additional work elements included in Phase V of the project to be performed in the future with costs of $3,650,000 - grantor share of $2,920,000 and City share of $730,000 - will require further Common Council approval in 2007 and 2008; and

 

Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and/or changes in scope approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns and/or changes in scope as approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by WISDOT should the City decide to withdraw from the project; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is authorized to construct streetscape improvements on West Wisconsin Avenue from the Milwaukee River to North 2nd Street to include sidewalk improvements, street lighting upgrades, landscaping, wayfinding system and other pedestrian amenities; and be it

 

Further Resolved, That upon approval of this contract, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project; and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share not to exceed $150,000, or $5,000, whichever is greater as follows:
