Title

Resolution for the improvement of street light equipment, traffic control signage, and traffic control signals in conjunction with streetscaping under the Federal Congestion Mitigation/Air Quality Program on West Wisconsin Avenue from North 2nd Street to the Milwaukee River, at a total additional estimated cost of $258,356.45, with the State share of $206,685.16, and City share of $51,671.29.

Analysis

This resolution authorizes the Commissioner of Public Works and Comptroller to enter into a funding agreement with the Wisconsin Department of Transportation for installation of street lighting and traffic control improvements in conjunction with the paving of West Wisconsin Avenue in the 4th Aldermanic District at a total additional estimated cost of $258,356.45, with an estimated State share of $206,685.16, and an estimated City share of $51,671.29, and to install these improvements upon execution of the agreement. This resolution also authorizes the Comptroller to establish and transfer funds to the appropriate accounts for the project.  The total estimated cost of the project (Grants I, II, and III) is $24,053,197.50, with a grantor share of $19,226,558, and a city share of $4,806,639.50.

Body

Whereas, The Wisconsin Department of Transportation (WISDOT) has approved funding to continue the implementation of streetscape improvements on primary pedestrian corridors in the Milwaukee Central Business District under the Federal Congestion Mitigation/Air Quality (CMAQ) program for projects which can be expected to reduce congestion, or to reduce vehicle emissions; and

 

Whereas, Common Council Resolution File Number 981733, File Number 990806, File Number 021033, File Number 040147, and File Number 060921 authorized the Commissioner of Public Works to execute agreements for the programming and construction of pedestrian friendly improvements on East/West Wisconsin Avenue, North Water Street and East/West Kilbourn Avenue under the CMAQ Program to undertake preliminary engineering for this pedestrian corridor development project; and

 

Whereas, The Common Council previously authorized the execution of separate funding agreements with WISDOT for traffic control and street lighting improvements included in prior phases of this streetscape Project under Common Council File Number 030467, File Number 030803, File Number 040627, File Number 040626, File Number 050364 and File Number 060386; and

 

Whereas, These streetscape improvements are being implemented to improve the pedestrian environment in the Milwaukee Central Business district to promote walking as an alternative to automobile trips within the Downtown area; and

 

Whereas, Streetscape improvements have been implemented or are under construction on East Wisconsin Avenue from the Milwaukee River to the intersection of East Mason Street and North Prospect Avenue, and West Wisconsin Avenue from North 10th Street to North 2nd Street under previous phases of this project; and

 

Whereas, Construction of streetscape improvements proposed under this project will include West Wisconsin Avenue from North 2nd Street to the Milwaukee River, thereby fully completing the development of the primary east/west pedestrian corridor through the downtown area; and

 

Whereas, Street lighting and traffic control improvements proposed to be implemented in conjunction with this phase of the streetscape improvement project are eligible for federal funding under the CMAQ project using uncommitted funds for the first through this phase of the Downtown pedestrian improvement project; and

 

Whereas, The total estimated cost of this project is $258,356.45 for the upgrade of street lighting, traffic control signs and traffic control signals; and

 

Whereas, Twenty percent of the participating costs, or $51,671.29 is non-reimbursable and is included in the Division’s 2007 Capital Purpose Project /Grant Number ST320070000; and

 

Whereas, Eighty percent of the participating project costs, or $206,685.16, is reimbursable from WISDOT, and this amount is not included in Division accounts, and should be earmarked for this project in the Capital Grant and Aids Projects Fund Project/Grant Number SP032070100; and

 

Whereas, After successful completion of existing elements, additional elements with costs of $2,038,625 - grantor share $1,630,900 and City share $407,725 - will be requested through Common Council resolution in 2007 and 2008; and

 

Whereas, Funding and construction of street lighting and traffic control improvements can be authorized by WISDOT through execution of a Local Force Account Contract for construction; and

 

Whereas, WISDOT has requested that all City Forces work be funded using construction funds established for this project; and

 

Whereas, The State cannot proceed with any project cost overruns and/or changes in scope of more than 5 percent without prior Department of Public Works approval; and   

 

Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and/or changes in scope approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100 percent liable for any such project cost overruns and/or changes in scope as approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and Comptroller are authorized to enter into a funding agreement with WISDOT for the installation of street lighting and traffic control facilities in conjunction with the improvements to West Wisconsin Avenue from North 2nd Street to the Milwaukee River based on a predetermined estimate prepared under the Federal/State aided highway program, a copy of which is attached to this resolution, and is incorporated into this resolution as though set forth in full; and, be it

 

Further Resolved, That upon approval of this contract, the Commissioner of Public Works is authorized to install and modify street lighting and traffic control facilities in conjunction with the improvements to West Wisconsin Avenue from North 2nd Street to the Milwaukee River; and, be it

 

Further Resolved, That upon approval of this contract, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield values for this project; and transfer to these accounts the amount required under the project agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share not to exceed $150,000, or $5,000, whichever is greater, as follows:
