Title

Resolution authorizing and directing the Commissioner of Public Works to execute a document titled "Federal/State/Project Sponsor, Safe Routes to School Program, Project Agreement" with the Department of Transportation for the programming of a project known as Forest Home/Oklahoma/43rd Street Pedestrian Enhancement with total preliminary engineering costs being $30,000.

Analysis

This resolution authorizes and directs the Commissioner of Public Works to execute the Project Agreement with the Wisconsin Department of Transportation (WISDOT) for the programming of the Forest Home/Oklahoma/43rd Street Pedestrian Enhancement Project.  The entire project will be funded 100 percent by Federal and/or State participation.  The preliminary engineering costs will be $30,000 and construction costs will be $370,000 of which the City share is zero.  The total project grant is $400,000.

Body

Whereas, The City of Milwaukee has actively promoted the expansion of bicycle and pedestrian facilities; and

 

Whereas, The City of Milwaukee applied for grant funding under the Transportation Enhancements Program for a project known as Forest Home/Oklahoma/43rd Street Pedestrian Enhancement; and

 

Whereas, The Wisconsin Department of Transportation chose to fund the project with Federal Safe Routes to School (SRTS) funds; and

 

Whereas, SRTS Funds will fund 100 percent of the project, up to $400,000; and

 

Whereas, WISDOT has submitted a Project Agreement to be executed by the City of Milwaukee for the programming of the project and to begin engineering; and

 

Whereas, The construction phase will be included in a future resolution; and

 

Whereas, The State cannot proceed with any project cost overruns and/or changes in scope of more than 5% without prior Department of Public Works (DPW) approval; and

 

Whereas, The DPW shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project overruns and/or changes in scope approved by DPW; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns and/or changes in scope as approved by DPW; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to execute the Project Agreement for the programming of the Forest  Home/Oklahoma/43rd Street Pedestrian Enhancements Project, a copy of which is attached to Common Council Resolution File Number 061546 and is incorporated in this resolution by reference as though set forth in full; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to undertake or engage a consultant to undertake the above-mentioned project and to reimburse WISDOT for costs they incur for the project with SRTS funds; and, be it

 

Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for preliminary engineering for this project and transfer to these accounts the amount required under the grant agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater as follows:
