Analysis
This resolution authorizes settlement of the lawsuit of the Estate of Edward Pundsack et al. v. City of Milwaukee, et al Case No. 04-C-1207, Dawn Pundsack and Douglas Pundsack v. City of Milwaukee, Arthur Jones and Mark Wagner, in the total amount of $50,000.

Whereas, The plaintiffs, the Estate of Edward Pundsack, Dawn Pundsack, the child of Mr. Pundsack and Mr. Pundsack’s father, have filed a civil rights lawsuit against the City of Milwaukee, former Chief Arthur Jones and Sergeant Mark Wagner; and
Whereas, The parties have entered into a settlement agreement, to settle the above-referenced lawsuit for the total amount of $50,000; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to settle this lawsuit; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $50,000 payable to the order of Davis & Gelshenen, LLP, Iolta Client Trust Account, in full and final settlement of this lawsuit, said amount to be charged to the Damages and Claims Fund, Account No. 0001-1490-0001-S118-006300; and, be it
Further Resolved, That for and in consideration of the above-referenced payment, plaintiffs and their attorneys will provide to the City a release of any and all claims arising out of or in any way related to this incident and a stipulation and order for dismissal of the pending court action.
