Analysis
This ordinance allows the building owner or applicant to provide proof of application for an occupancy certificate in lieu of submitting a valid occupancy certificate when applying for an extended hours establishment license, but the license shall not be issued until proof of a valid occupancy certificate is provided.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 84-7-5-e of the code is amended to read:

84-7. Extended Hours Establishments.

5. APPLICATION.

e. The building owner or applicant shall file with the license application a valid occupancy certificate issued by the commissioner of city development for the operation of the premises >>, or provide proof of having applied for an occupancy certificate<<.

Part 2. Section 84-7-10-a of the code is amended to read:

10. ISSUANCE.

a. Applications shall be referred to the chief of police, the commissioner of neighborhood services and the commissioner of health who shall cause an investigation to be made and report their findings to the licensing committee. If no objection is filed to an application, the license shall be forwarded to the common council for approval. >>The common council may grant an extended hours establishment license prior to issuance of an occupancy certificate, but the extended hours establishment license shall not be issued until proof of the issuance of the occupancy certificate is provided.<< If an objection is filed to an application, the license shall be forwarded to the licensing committee for its recommendation as to whether or not each license should be issued.
