Body
Whereas, Koehring Company requested permission to construct and maintain a chain link fence along the west side of North 30th Street and the north side of West Concordia Avenue; and

Whereas, Site visits had revealed the presence of three pole mounted yard lights and four bollards in the public right-of-way; and

Whereas, Permission for said items was granted in 1968 under Common Council File Number 68-774; and

Whereas, West Concordia Avenue at the location of the permitted fence has been vacated; and

Whereas, A site visit revealed that the yard lights and bollards had been removed from the public right-of-way; and

Whereas, M & R Land Company, LLC now owns the property; and

Whereas, For the liability to be formally transferred to the current property owner, the Common Council needs to adopt an amending resolution; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that Common Council File Number 68-774 is hereby rescinded; and, be it

Further Resolved, That M & R Land Company, LLC, PO Box 16736, Milwaukee, Wisconsin 53216, is hereby granted the following special privilege:

To keep and maintain a chain link fence in the west, 15-foot wide sidewalk area of North 30th Street. Said fence commences at the centerline of the vacated West Concordia Avenue and extends south approximately 702 feet to the southline of West Townsend. Said 6-foot tall fence is 4 feet east of the westline of North 30th Street.
