Resolution authorizing payment of up to $100,000 from the Damages and Claims Fund to pay claims from the Law Firm of Miller & Van Eaton for legal fees in 2006 in regard to litigation and negotiation with AT&T regarding its U-verse video service in the City of Milwaukee.
Analysis
Body
Whereas, AT&T has given notice to the City of its intent to turn on its U-verse video service in the City of Milwaukee sometime in the month of December, 2006; and
Whereas, The City has advised AT&T that this service is “cable service” for purposes of the City’s cable ordinance; and
Whereas, AT&T has advised the City that it does not believe that its new service is in fact cable service for purposes of the City’s ordinance; and
Whereas, The City may commence litigation against AT&T to determine whether or not its U-verse service is cable service for purposes of the ordinance; and
Whereas, The City may attempt to negotiate with AT&T an interim operating agreement while the litigation runs its course; and
Whereas, The City wishes to retain the law firm of Miller & Van Eaton as outside counsel to the City of Milwaukee on this matter; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that up to $100,000 be reserved from the Damages and Claims Fund to pay claims for legal fees from Miller & Van Eaton as outside counsel to the City of Milwaukee; and, be it
Further Resolved, That the proper City officers are authorized and directed to carry out the provisions of this resolution by paying these claims as they come due.
