Title

Substitute resolution authorizing and directing the proper City officers to execute a bill of sale for the acceptance of a combined sewer overflow located in West Potawatomi Circle.

Analysis

This substitute resolution authorizing and directing the proper City officers to execute Bill of Sale SC-2784 for the conveyance of ownership, from the Milwaukee Metropolitan Sewerage District (MMSD) to the City, of a combined sewer overflow (CSO) located from a point in West Potawatomi Circle to its termination point at the Menomonee River.

Body

Whereas, On November 9, 2005, the City formally requested the transfer of ownership of the Combined Sewer Overflow (CSO) located in West Potawatomi Circle from Milwaukee Metropolitan Sewerage District (MMSD); and

Whereas, On September 25, 2006, MMSD passed a resolution allowing for the transfer of ownership of the CSO; and

Whereas, The CSO will be converted to be used as a storm sewer; and

Whereas, By accepting ownership of the CSO, the City will be able to develop adjacent properties without having to construct new storm sewers; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized and directed to execute Bill of Sale SC-2784, said bill of sale is hereto attached and made part of this resolution; and, be it

Further Resolved, That after said bill of sale has been executed by the proper City officers, it shall be forwarded to the office of the City Attorney for approval as to form and execution and then to the Department of Public Works for recording and proper distribution.
