Title

Resolution granting the Washington Heights Neighborhood Association permission to place bus benches on various street corners in its neighborhood within various public rights-of-way, in the 10th Aldermanic District.

Analysis

This resolution permits Washington Heights Neighborhood Association to install and maintain bus benches on various street corners within the Washington Heights Neighborhood in various public rights-of-way subject to review and approval of the Commissioner of Public Works.

Body

Whereas, Washington Heights Neighborhood Association is a non-profit association of residents of the Washington Heights Neighborhood, working to improve their neighborhood; and

 

Whereas, Washington Heights Neighborhood Association desires to place bus benches at various street corners within the Washington Heights Neighborhood in order to beautify the neighborhood; and

 

Whereas, Said bus benches will be artistically embellished prior to installation by local Milwaukee artists; and

 

Whereas, Washington Heights Neighborhood Association is willing to maintain any bus benches installed in the public right-of-way as well as the area adjacent to said benches; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that Washington Heights Neighborhood Association is granted permission to install and maintain bus benches in the public right-of-way within the Washington Heights Neighborhood as described below:

 

1.                     Southwest corner of North 49th Street and West Washington Boulevard

 

2.                     Southeast corner of North 47th Street and West Washington Boulevard

 

3.                     Southwest corner of North 47th Street and West Washington Boulevard

 

4.                     Northwest corner of North 47th Street and West Cherry Street

 

5.                     Northeast corner of North 49th Street and West Vliet Street

 

6.                     Southwest corner of North 49th Street and West Vliet Street

 

7.                     Northwest corner of North Hawley Road and West Vliet Street

 

8.                     Southwest corner of North Hawley Road and West Vliet Street

 

9.                     Southwest corner of North Hawley Road and West Washington Boulevard

 

10.                     Northeast corner of North Hawley Road and West Washington Boulevard

 

11.                     Northeast corner of North 53rd Street and West Washington Boulevard

 

12.                     Southwest corner of North 53rd Street and West Washington Boulevard

 

13.                     Northeast corner of North 49th Street and West Washington Boulevard

 

; and, be it

 

Further Resolved, That location and method of installation of each bench shall be subject to the approval of the Commissioner of Public Works; and, be it

 

Further Resolved, That Washington Heights Neighborhood Association shall obtain all necessary permits for the installation of any benches placed in the public right-of-way; and, be it

 

Further Resolved, That Washington Heights Neighborhood Association shall keep and maintain the benches to the satisfaction of the Commissioner of Public Works; and, be it

 

Further Resolved, That whenever permission for the benches is discontinued for any reason whatsoever, including public necessity whenever so ordered by resolution adopted by the Common Council, Washington Heights Neighborhood Association shall not only remove all benches, but shall also restore to its former condition and to the approval of the Commissioner of Public Works the curb, pavement or other public improvement which was removed, changed or disturbed by reason of the granting permission for said signs. Such grantee shall be entitled to no damages due to the alteration and/or removal for such purposes.
