Analysis

Schiller Street, S. Howell Avenue, E. Dewey Place, and S. Austin Street and acceptance of dedication for public right-of-way.
Body
Whereas, The City currently has public right-of-way alleyways in the block bounded by E. Schiller Street, S. Howell Avenue, E. Dewey Place, and S. Austin Street; and

Whereas, The existing alley right-of-ways are gravel only and narrow (the north-south alleyway right-of-ways are only 15 feet wide and the east-west alleyway right-of-way is only 10 feet wide); and

Whereas, Department of Public Works (DPW) and City Attorney representatives negotiated with the Kotniks (owners of 2905 S. Howell Avenue and 2904-R S. Austin Street), regarding widening and paving of the alleyways; and

Whereas, The Kotniks agreed to dedicate to the City as public right-of-way additional lands needed to widen the alleyways; and

Whereas, The above-referenced agreement is embodied and reflected in that certain “Agreement to Dedicate Lands for Public Right-of-Way” a copy of which is part of this file (the “Agreement”); and

Whereas, The Council, by Resolution File No. 060135, approved the paving and special assessments associated with the alleyways; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are authorized to enter into and finalize the Agreement and to take all requisite acts and actions contemplated thereby - including acceptance on behalf of the City of the...
