TITLE
Resolution authorizing City officials to execute an Out-of-Program Agreement between KJ Greentree and the City of Milwaukee for the design and construction of various improvements related to the Direct Supply expansion project.
ANALYSIS
This resolution approves an out-of-program agreement for the Direct Supply expansion project. Under the terms of the out-of-program agreement, KJ Greentree, Direct Supply’s landlord, would provide funds for access alterations at the City’s Industrial Road self help center / transfer station and for crosswalk improvements across N. Industrial Road. In addition, KJ Greentree would install a screening fence along the front of the self help center / transfer station. The terms and conditions of the out-of-program agreement are consistent with and within the context of the previously approved term sheet for the Direct Supply expansion project.
BODY
Whereas, Direct Supply, Inc. and the City of Milwaukee have agreed upon a term sheet outlining the responsibilities of each to accomplish the company’s growth plans (Common Council file number 060420 adopted July 12, 2006); and

Whereas, Direct Supply is a tenant in buildings owned and managed by KJ Greentree; and

Whereas, KJ Greentree is representing Direct Supply for the purpose of implementing various improvements encompassed within the above referenced term sheet; and

Whereas, KJ Greentree wishes to enter into an Out-of-Program Agreement with the City in order to implement these improvements; and

Whereas, Funding for the improvements would be provided by Direct Supply and/or KJ Greentree at no cost to the City; and

Whereas, An Out-of-Program agreement has been prepared and is attached to this file; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Out-of-Program Agreement attached to this file is hereby approved and the proper City officials are hereby authorized ...
