Analysis
This resolution authorizes and directs the proper City of Milwaukee officials to execute an agreement with William and Patricia Herget allowing them to use a portion of the unimproved North 124th Street right-of-way for access to their property at 12345 West Bobolink Avenue.
Body
Whereas, North 124th Street south of West Bobolink Avenue is presently unimproved public right-of-way; and

Whereas, William and Patricia Herget own the property at 12345 West Bobolink Avenue; and

Whereas, Permission for a private use of the unimproved public right-of-way for the construction of a driveway access can be granted in a Special Permission Agreement; and

Whereas, A Special Permission Agreement has been prepared, which specifies William and Patricia Herget shall bear all construction and maintenance costs associated with such access; and

Whereas, Permission to allow the above persons the private use of the public right-of-way for such access can only be approved by the Common Council; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City of Milwaukee officials are authorized and directed to execute a Special Permission Agreement allowing William and Patricia Herget the private use of a portion of the unimproved North 124th Street public right-of-way for access to their property at 12345 West Bobolink Avenue under the terms and conditions specified in the Special Permission Agreement attached to this resolution and incorporated in this resolution by reference as though set forth in full; and, be it
