Title

Substitute resolution authorizing and directing the proper City officers to accept a Quit Claim Deed for a private main sanitary sewer located in the proposed North 116^th Street, south of West Brown Deer Road, in the 9th Aldermanic District.

Analysis

This substitute resolution authorizes and directs the proper City officers to accept the Quit Claim Deed document for the transfer of ownership of the sanitary sewer from Bachaus Milwaukee, LLC to the City of Milwaukee.

Body

Whereas, Bachaus Milwaukee, LLC currently owns and maintains an 8-inch diameter sanitary sewer in the proposed North 116^th Street, south of West Brown Deer Road; and

Whereas, On July 11, 2006, Bachaus Milwaukee, LLC drafted a Quit Claim Deed to transfer ownership and future maintenance responsibilities for said sewer from Bachaus Milwaukee, LLC to the City; and

Whereas, By owning and maintaining the sewer, the City will be able to develop adjacent property without constructing a new sewer; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized and directed to accept the Quit Claim Deed for the conveyance of the sewer to the City, said Quit Claim Deed is hereto attached and made part of this resolution; and, be it

Further Resolved, That after said Quit Claim Deed has been accepted by the proper City officers, it shall be forwarded to the Office of the City Attorney for approval as to form and execution and then forwarded to the Office of City Real Estate for recording and proper distribution.
