Resolution approving Grant/Cooperation Agreement with the Milwaukee Board of School Directors for police services.
Analysis
This resolution approves a cooperation agreement between the City and the Milwaukee Board of School Directors (“Board”) for the provision of specified law enforcement services to the Board under the agreement. The Chief of Police (“Chief”) has agreed to assign fully marked police squads with two on-duty officers to patrol certain Board high schools. The schools include Washington High School, Madison University High School, Custer High School, Pulaski High School, Bay View High School, Vincent High School, South Division High School and Bradley Tech High School. The squads will patrol the high school areas between 3:00 p.m. and 4:30 p.m. each school day. The Board will reimburse the City for such services at the actual overtime rate of the officers providing the services. The total payments to the City from the Board shall not exceed $15,000 for the term of the agreement which commenced on May 22, 2006 and will end on June 12, 2006. Acceptance of this grant for police services from the Board, which is a tax exempt public entity, is consistent with the Common Council policy on accepting grants for additional police services as embodied in Common Council Resolution File Nos. 011573, 021317 and 040746.

Whereas, The Milwaukee Board of School Directors (“Board”) and the City of Milwaukee (“City”) both qualify as “municipalities” authorized to enter into contracts for the receipt or furnishing of services pursuant to Wisconsin Statute § 66.0301; and

Whereas, The Board has determined that non-students have been creating disturbances by confronting students, staff and others associated with the eight high schools listed herein while the latter are leaving the schools and in the vicinity of the schools; and

Whereas, The Board acting pursuant to section 66.0301 has requested the City Police Department (“MPD”) to provide patrol services more precisely defined herein to the eight area high schools listed herein between 3:00 p.m. until 4:30 p.m. on each school day; and

Whereas, The Milwaukee Chief of Police has agreed to specially assign police officers in accordance with the terms and conditions of this Cooperation Agreement; and

Whereas, Consistent with Common Council Resolution File No. 011573, 021317 and 040746, establishing a policy on the acceptance of grants for additional police services (hereinafter referred to as “the Policy”) the Common Council hereby finds that (a) the Board operates a public school district organized and operated under Chapter 119, Stats.; (b) the Board has offered the City a grant, the terms and conditions of which are contained in the Grant Cooperation Agreement attached to this file to fund the provision of additional law enforcement services at and around certain public high schools under the jurisdiction of the Board; (c) based upon the above enumerated findings, the Milwaukee Police Department is eligible under the terms of the previously adopted policy, to receive grant funds from the Board for the additional law enforcement services in accordance with the terms and conditions of the Grant/Cooperation Agreement attached to this file; and

Whereas, The Board has approved the Grant/Cooperation Agreement; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the grant for the provision of additional law enforcement services be accepted if the grantor qualifies under the criteria established in the Policy; and, be it

Further Resolved, By the Common Council of the City of Milwaukee that the grant application from the Board meets the criteria established in the Policy and on that basis, the Milwaukee Police Department shall accept this grant without further approval unless the terms of the grant change, as indicated in Common Council Resolution File No. 940843; and, be it

Further Resolved, That the Chief of Police is authorized to execute the Grant/Cooperation Agreement with the Board, a copy of which is attached to this file; and, be it

Further Resolved, That the City Comptroller is authorized to:

1. Commit funds within the Project/Grant Parent of the 2006 Special Revenue-Grant and Aid Projects Fund, the following amount for the program titled: “MBSD Grant”:

2. Create the necessary Grant and Aid Project/Grant and Project/Grant levels, budget against these Project/Grant values the amount required under the grant agreement;

Establish the necessary City Share Project Values; and be it

Further Resolved, That these funds are budgeted for the Milwaukee Police Department, which is authorized to:
1. Expend from the amount budgeted sums for the specified purposes, as indicated in the grant budget and incur costs consistent with the award date.

2. Transfer funds within the project budget as long as the amount expended for each specific purpose does not exceed the amount authorized by the budget by 10%.
