Title

Resolution granting the Wisconsin Department of Transportation permission to construct a three-lane drop-off and loading area and driveway curbing for the Milwaukee Intermodal Station located at 433 West St. Paul Avenue.

Analysis

This resolution permits the Wisconsin Department of Transportation to construct and maintain a three-lane drop-off and loading area and driveway curbing for the premises at 433 West St. Paul Avenue, also known as the Milwaukee Intermodal Station.

Body

Whereas, The Wisconsin Department of Transportation (WISDOT) is currently redeveloping the Milwaukee Amtrak Passenger Station; and

 

Whereas, As part of the redevelopment, WISDOT will be constructing a three lane drop-off and loading area, which will encroach up to 6 feet 8 inches into the south sidewalk area of West St. Paul Avenue; and

 

Whereas, WISDOT is also proposing to construct concrete curbing adjacent to the parking lot entrances and exits adjacent to the Milwaukee Intermodal Station; and

 

Whereas, WISDOT will maintain the aforementioned three lane drop-off and loading area and the concrete curbing; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Wisconsin Department of Transportation is granted permission to construct and maintain a three lane drop-off and loading area, to encroach up to 6 feet 8 inches into the south sidewalk area of West St. Paul Avenue, and concrete curbing at three parking lot entrances/exits; and, be it

 

Further Resolved, That WISDOT shall maintain, at minimum, 7 feet 6 inches of sidewalk width in the south sidewalk area of West St. Paul Avenue adjacent to the Milwaukee Intermodal Station; and, be it

 

Further Resolved, That WISDOT shall obtain all necessary permits for work performed in the public right-of-way; and, be it

 

Further Resolved, That WISDOT shall keep and maintain the three-lane drop-off and loading area and the concrete curbing to the satisfaction of the Commissioner of Public Works; and, be it

 

Further Resolved, That whenever permission for the three lane drop-off and loading area and the concrete curbing is discontinued for any reason whatsoever, including public necessity whenever so ordered by resolution adopted by the Common Council, the Wisconsin Department of Transportation shall not only remove all construction work executed pursuant to this permissory resolution, but shall also restore to its former condition and to the approval of the Commissioner of Public Works the curb, pavement or other public improvement which was removed, changed or disturbed by reason of the granting permission for said signs. Such grantee shall be entitled to no damages due to the alteration and/or removal for such purposes.
