Resolution authorizing and directing the Commissioner of Public Works to execute a revised project agreement titled “State/Municipal Agreement” for a highway improvement project with the Wisconsin Department of Transportation  for the resurfacing of West Silver Spring Drive from North 68^th Street to North 27^th Street with a total estimated project cost of $4,441,054, a federal share of $3,552,843 and a city share of $888,211. 

Analysis

This resolution authorizes and directs the Commissioner of Public Works to execute a revised project agreement for the resurfacing of Silver Spring Drive from North 68^th Street North 27^th Street to include Federally Earmarked funds for streetscaping items in the portion of the project between North 43^rd Street and North 68^th Street and to authorize and direct the City Comptroller to create the necessary subaccounts, and or transfer the necessary funds to pay the City of Milwaukee’s local share of the streetscaping item through the Business Improvement District funding set up by the Department of City Development.  Total estimated cost for West Silver Spring Drive from North 68^th Street to North 27^th Street is $4,441,054.  The City’s share is $888,211.  The total estimated cost for streetscaping from North 43^rd Street to North 68^th Street is $108,935 and the City’s share is $21,787 which will be funded by the BID.

Whereas, The Common Council of the City of Milwaukee adopted Resolution File Number 011166 on January 22, 2002 authorizing and directing the Commissioner of Public Works to execute a State/Municipal Agreement with the Wisconsin Department of Transportation (WISDOT) for the programming and construction of West Silver Spring Drive from North 68^th Street to North 27^th Street; and

Whereas The Department of Public Works (DPW) received a request through the Department of City Development (DCD) from the Business Improvement District (BID), represented by Havenwoods Economic Development Corporation, to delay the section of the project between North 43^rd Street and North 68^th Street to allow time to incorporate some street enhancement items into the portion of the project covered by the BID; and

Whereas, DPW agreed and broke the construction of the project into two phases, Phase I going from North 27^th Street to North 43^rd Street and Phase II going from North 43^rd Street to North 68^th Street; and

Whereas, Phase I of the project was constructed in 2005 for $1,034,300 and Phase II of the project will be constructed beginning summer of 2006 and completed by November 2006; and

Whereas, Bids for West Silver Spring project North 43^rd Street to North 68^th were opened and came in at $2,013,350; and

Whereas, The specialized treatments requested by Havenwoods Economic Development Corporation were included with Phase II of the paving project and originally funded 100% by the BID; and

Whereas Havenwoods Economic Development Corporation, independent of the City of Milwaukee, applied for and received from the State, Federal Earmarked funds to cover 80 percent of the cost of the specialized items included with the paving of Silver Spring Drive between North 43^rd Street and North 68^th Street, with the remaining 20 percent of the cost being local share; and

Whereas, Total Federal Earmarked funds available for this project are $87,148; and

Whereas, In order to take advantage of the Federally Earmarked funds and to include the requested specialized items in Phase II of the paving project WISDOT requires a revised State/Municipal Agreement be executed for Silver Spring Drive including the Federally Earmarked funds at an 80 percent Federal 20 percent local split; and

Whereas, The local share (20 percent) of the specialty items requested by Havenwoods Economic Development Corporation will be funded 100% by the BID and funding for the specialty items through the BID has been previously authorized by Common Council Resolution 050808 (attached) adopted November 15, 2005 at a total cost of $513,000; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to execute a revised State/Municipal Agreement with WISDOT for the Silver Spring Drive paving project between North 27^th Street and North 68^th Street that shows both phases of the project and now includes Federal Earmarked funds for streetscaping items to be included within the project limits of the BID; and

Further Resolved, The City Comptroller is authorized and directed to create the necessary Project/Grant Chartfield Values for the Federally Earmarked and BID funding and to transfer to/from BID accounts the amount required under the grant agreement.
