This resolution amends a special privilege for change of ownership to Columbia St. Mary’s, Inc. for retaining walls previously granted permission for the premises at 8430 West Capitol Drive.
Body
Whereas, Westgate Building Partnership petitioned for a special privilege to keep and maintain retaining walls in the public right-of-way; and

Whereas, Permission for said items was granted in 1984 under Common Council File Number 84-1046; and

Whereas, Columbia St. Mary’s, Inc. now owns the property; and

Whereas, For the liability to be formally transferred to the current property owner, the Common Council needs to adopt an amending resolution; now, be it

Resolved, By the Common Council of the City of Milwaukee, that Common Council File Number 84-1046 is hereby rescinded; and, be it

Further Resolved, That Columbia St. Mary’s, Inc., East Lake Towers Corporate Center, Attn: Legal Dept., P.O. Box 2014, Milwaukee, Wisconsin 53201-2014 is hereby granted the following special privilege:

To keep and maintain two, 9-inch wide, 7-inch tall lannon stone retaining walls, which encroach 1-foot into the north, 12-foot wide sidewalk area of West Capitol Drive. The western retaining wall begins at the eastline of North 85th Street and extends approximately 31 feet 8 inches to the east. The eastern retaining wall begins at a point approximately 47 feet east of the eastline of North 85th Street and extends east 28 feet 7 inches.

Said above-mentioned items shall be used, kept and maintained to the satisfaction of the Commissioners of Public Works and Department of Neighborhood Services. All necessary permits shall have been obtained pr...
