Title

Resolution approving Amendment No. 1 to the Green Tree Business Park Redevelopment Plan, in the 9th Aldermanic District.

Analysis

Adoption of this resolution by at least two-thirds vote of the Common Council will approve a redevelopment plan amendment for the above-identified project area to designate properties for acquisition by the Redevelopment Authority and to expand permitted uses in the project area. Such approval is a prerequisite for exercising the powers granted to the Redevelopment Authority under Wisconsin law for implementation of the amendment following adoption of this resolution.

Body

Whereas, In File No. 030357 adopted November 5, 2003, the Common Council of the City of Milwaukee (“Council”) approved a Redevelopment Plan prepared by the Redevelopment Authority of the City of Milwaukee (“Authority”) for approximately 65 acres of undeveloped land formerly known as Bacher Farms and located in the vicinity of North 60th Street and West Green Tree Road that identified the land as the Green Tree Business Park Project Area; and

 

Whereas, Approximately 25 acres in the Green Tree Business Park has been identified by the United States Department of Labor (“DOL”) as a desirable location for the Milwaukee Job Corps, a federally funded job training facility, because of its proximity to area employers as well as its easy accessibility by DOL’s target market for trainees; and

 

Whereas, In order to allow DOL to develop the Job Corps campus in the Green Tree Business Park Project Area, Amendment No. 1 to the Green Tree Business Park Redevelopment Plan (“Amendment”) was prepared, a copy of which is attached to this Common Council File, to allow educational and residential use in a portion of the project area and to designate all property in the project area to be acquired by the Authority; and

 

Whereas, The Authority gave proper notice to the property owner of the proposed amendment to allow additional land uses and to acquire all property within the project boundary and conducted a Public Hearing on April 20, 2006, pursuant to Wisconsin Statutes after which it approved the Amendment; and

 

Whereas, Pursuant to Wisconsin Statutes, the Council must approve all amendments to a redevelopment plan and approve all property acquisitions by the Authority; and

 

Whereas, The City Plan Commission of the City of Milwaukee reviewed the Amendment and determined that it conforms to the general plan of the City of Milwaukee and to local objectives as to appropriate land uses, improved traffic, public transportation, public utilities, recreational and community facilities and other public improvements in the Project Area as provided in Section 66.1333(4)(b), Wisconsin Statutes; and

 

Whereas, Funding to implement the Amendment shall be provided by the Authority and will be reimbursed in part through the property sale to DOL; and

 

Whereas, The Amendment prescribes certain land uses of the Project Area that may require, among other things, the vacation and removal of certain streets or other public ways, the provision of public works and facilities, the location and relocation of sewer and water mains and other public and private utilities and facilities and any other public actions deemed necessary to carry out the Amendment; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that Amendment No. 1 to the Green Tree Business Park Redevelopment Plan is approved; and, be it

 

Further Resolved, That the Council finds that:

 

1. The Amendment is feasible and conforms to the general plan of the City of Milwaukee and to the City’s objectives for area development.

 

2. Financial assistance is to be provided by the Authority.

 

3. Where clearance is proposed, the objectives of the Amendment cannot be achieved through rehabilitation or conservation; and, be it

 

Further Resolved, That to implement and facilitate the prosecution of the Amendment as approved, certain official actions to support new land uses in the area after redevelopment may be required and which, among other things, may include the vacation and removal or establishment of certain streets, the provision of public works and facilities and to the public and semi-public ways, the location and relocation of sewer and water mains and other public and private utilities, facilities and installations and any other public actions deemed necessary to carry out the Amendment, the Council:

 

1. Pledges its cooperation and stands ready to consider and take appropriate affirmative action on proposals and measures designed to effectuate the Amendment including the future adoption of a resolution prohibiting new construction in the Project Area pursuant to the provisions of Section 66.1333(6)(e), Wisconsin Statutes.

 

2. Authorizes and directs all other City officials, departments, boards, authorities, commissions and agencies having administrative jurisdiction over the premises located within the area identified in the Amendment to likewise take all such actions and to provide all such assistance to the Authority and to the Department of City Development as may be needed from time to time; and, be it

 

Further Resolved, That the City Clerk is directed to transmit a certified copy of this resolution to the Commissioner of the Department of Public Works, the Commissioner of Neighborhood Services, the City Engineer, the Assessment Commissioner, the Housing Authority of the City of Milwaukee, the Redevelopment Authority of the City of Milwaukee and to such other agencies, boards and commissions of the City having administrative jurisdiction in the Project Area described above; and, be it

 

Further Resolved, That upon Council approval of this resolution, the Authority shall record a copy of the Amendment in the Office of the Register of Deeds for Milwaukee County and is authorized to purchase property in the Project Area as identified in the Amendment.
