Analysis

This resolution authorizes and directs the proper City officers to execute one Release of Railroad Agreement with the City of Milwaukee Redevelopment Authority in South 35^th Street (Below Viaduct) from West Canal Street (Original) to 130’ N/O West Pierce Street.

Body

Whereas, In 1901, the City of Milwaukee and the Chicago, Milwaukee & St. Paul Railway Company executed an agreement granting the City the right to lay down, and thereafter perpetually maintain and use a 12” water pipe; and

Whereas, The 12” water main referenced in said agreement has been abandoned; and

Whereas, This agreement is no longer required for future water purposes and does not serve the interests of the City of Milwaukee and should be released; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized and directed to execute the document for Release of Water Agreement, W.E. 923R, a copy of which is attached to and part of this resolution; and, be it

Further Resolved, That after said agreement release has been executed by the proper City Officers, it shall be forwarded to the Department of Public Works for recording and proper distribution.
