Analysis

This resolution authorizes and directs the proper City officers to execute one Release of Railroad Agreement with the City of Milwaukee Redevelopment Authority in South 35th Street (Below Viaduct) from West Canal Street (Original) to 130’ N/O West Pierce Street.

Body

Whereas, In 1901, the City of Milwaukee and the Chicago, Milwaukee & St. Paul Railway Company executed an agreement granting the City the right to lay down, and thereafter perpetually maintain and use a 12” water pipe; and

 

Whereas, The 12” water main referenced in said agreement has been abandoned; and

 

Whereas, This agreement is no longer required for future water purposes and does not serve the interests of the City of Milwaukee and should be released; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized and directed to execute the document for Release of Water Agreement, W.E. 923R, a copy of which is attached to and part of this resolution; and, be it

Further Resolved, That after said agreement release has been executed by the proper City Officers, it shall be forwarded to the Department of Public Works for recording and proper distribution.
