Title
Resolution accepting a quit claim deed to dedicate West Brittany Way east of North Lauer Street to Tara Vista Estates on Certified Survey Map No. 6654 in the 9th Aldermanic District.
Analysis
This resolution permits the City of Milwaukee to accept a quit claim deed to dedicate land for public right-of-way.
Body
Whereas, Certified Survey Map (“CSM”) No. 6654 at the southwest corner of West Brown Deer Road and North Lauer Street included a reservation to the City of Milwaukee (“City”) for a future 70-foot wide public street along the southern portion of Parcel 2 at 8701 North Lauer Street in anticipation of future development of the land to the west; and

Whereas, By adoption of File No. 050625 on October 18, 2005, the Common Council rejected this reservation because the proposed development of the land to the west as Tara Vista Estates contemplates a public right-of-way along the northern portion of Parcel 2 of CSM No. 6654; and

Whereas, The property owner of Parcel 2 of CSM No. 6654 has agreed to convey and dedicate land along the north property line to the City so that West Brittany Way can be extended from Tara Vista Estates to North Lauer Street as illustrated on a map, a copy of which is attached to this Common Council File; and

Whereas, The legal description of the property to be acquired and dedicated is as follows:

The North 60.00 feet of Parcel 2 of Certified Survey Map No. 6654 in the Northeast 1/4 of Section 7, Township 8 North, Range 21 East; and

Whereas, The property owner has agreed to quit claim this land for West Brittany Way to the City for no monetary consideration and the deed will include a restriction to prohibit vehicular access to West Brittany Way from the adjoining industrial properties; and

Whereas, The City Plan Commission has approved acquisition and dedication of land for extension of West Brittany Way; now, therefore, be it
