Title

A substitute ordinance to grant an airspace lease to the Redevelopment Authority of the City of Milwaukee for a skywalk to be constructed over West Cherry Street between North Dr. Martin Luther King Jr. Drive and the former North 2^nd Street.

Analysis

In accordance with state law, this ordinance will grant an airspace lease to the Redevelopment Authority of the City of Milwaukee for construction of a skywalk in conjunction with the Manpower Project.  The Redevelopment Authority will assign the airspace lease to the Brewery Works, Inc. in conjunction with a lease of the parking structure to be constructed as part of the Project.

Body                     

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. FINDINGS. In accordance with the provisions of s.66.091(4), Stats., the Common Council of the City of Milwaukee hereby authorizes, directs and agrees that the City of Milwaukee enter into a lease with the Redevelopment Authority for the purpose of enabling the Redevelopment Authority to construct, use and maintain a skywalk over West Cherry Street, between North Dr. Martin Luther King,Jr. Drive and the former North 2^nd Street as described in the lease, and the Common Council of the City of Milwaukee hereby finds that said space above the above-described street is not needed for street, alley or other public purposes.

Part 2. The Common Council of the City of Milwaukee further finds that the public interest will be served by such leasing inasmuch as the skywalk will aid in the redevelopment of the downtown area; and that the Redevelopment Authority will bear the cost of any relocating, reconstructing and abandonment of private and public improvements in the street as may become necessary.

Part 3. A copy of the lease is attached hereto and is made part of Common Council File No. 051369.

Part 4. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed. 

Part 5. The Department of City Development through its real estate section shall process, with City department funds, the recording of this ordinance with the Milwaukee County Register of Deeds and shall forward the recording information complete with a final copy of the ordinance and lease to the City Engineer, and the City Comptroller.

Part 6. This ordinance shall take effect and be in full force from and after its passage and publication.
