A substitute ordinance relating to public passenger vehicle regulations.

Analysis

This ordinance establishes the following:

1. Taxicabs shall be equipped with a permanently installed air conditioning system capable of reducing the interior temperature of the passenger section to 68 degrees Fahrenheit. A vehicle is exempt from the air conditioning requirement if the vehicle has been continually licensed as a public passenger vehicle by the vehicle owner prior to the effective date of this ordinance.

2. Public passenger vehicle drivers are prohibited from smoking or permitting any person to smoke in the vehicle, regardless of whether the vehicle is transporting a passenger or a passenger has granted the driver permission to do so.

3. Public passenger vehicle drivers are prohibited from using while on duty alcohol or a controlled substance, or driving or operating a vehicle while intoxicated or under the influence of alcohol or a controlled substance, or under the influence of any drug which renders the person incapable of safely driving.

4. Every public passenger vehicle driver prior to the beginning of each shift shall inspect the vehicle to make sure that all equipment on the vehicle is operable and in good working condition and that the vehicle is maintained in a reasonably clean condition on the inside and outside. In addition, the vehicle owner shall cause to be maintained for each vehicle operated a monthly inspection log showing the time and date of each inspection and the condition of the vehicle at the time of inspection.

5. All public passenger vehicles shall be washed a minimum of once per week.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 100-51-7-h of the code is amended to read:

 

100-51. Vehicle Inspection.

 

7. GENERAL REQUIREMENTS.

 

h. Each motor vehicle shall have a heater and defroster that is in good working condition>>and shall be equipped with a permanently installed air conditioning system capable of reducing the interior temperature of the passenger section to 68 degrees Fahrenheit. A motor vehicle is exempt from the air conditioning requirement contained in this paragraph if the vehicle has been continually licensed as a public passenger vehicle by the vehicle owner prior to the effective date of this ordinance, July 23, 2005<<.

 

Part 2. Section 100-59-9-e and f of the code is created to read:

 

100-59. Operating Regulations for All Public Passenger Vehicles.

 

9. PROHIBITED ACTIVITIES.

 

e. Carrying or permitting any person to carry a lighted cigar, cigarette, pipe or any other lighted smoking equipment in any vehicle, regardless of whether the vehicle is transporting a passenger or a passenger has granted the driver permission to do so.

f. Using while on duty alcohol, a controlled substance, a controlled substance analog or a combination thereof, or driving or operating a vehicle while intoxicated or under the influence of alcohol, a controlled substance, a controlled substance analog or a combination thereof, or under the influence of any drug which renders the person incapable of safely driving.

 

Part 3. Section 100-59-14 of the code is created to read:

 

14. DUTY TO INSPECT VEHICLE. Every driver prior to the beginning of each shift shall inspect the vehicle to make sure that all equipment on the vehicle is operable and in good working condition and that the vehicle is maintained in a reasonably clean condition on the inside and outside. All vehicles shall be washed a minimum of once per week. The permittee shall cause to be maintained for each vehicle operated a monthly inspection log showing the time and date of each inspection and the condition of the vehicle at the time of inspection. The permittee shall retain the inspection logs for at least 60 days following the last day of the month for which the log was maintained, and inspection logs shall be readily available for inspection upon request by the police department.
