Substitute resolution relating to a lease agreement with Residents for Off-Leash Milwaukee Parks for use of public right-of-way as an off-leash dog park.
Analysis
This resolution authorizes and directs the proper City officials to draft and execute a lease agreement between the City and Residents for Off-Leash Milwaukee Parks for use of public right-of-way located immediately northwest of the intersection of East Lincoln Avenue (grade-level portion) and South Bay Street as an off-leash dog park.

Whereas, Residents for Off-Leash Milwaukee Parks desires to use public right-of-way located immediately northwest of the intersection of East Lincoln Avenue (grade-level portion) and South Bay Street, underneath the Lincoln Avenue overpass above Bay Street, as an off-leash dog park; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the City Attorney is authorized and directed to draft, with assistance from the Commissioner of Public Works, a lease agreement between the City and Residents for Off-Leash Dog Parks to allow Residents for Off-Leash Milwaukee Parks to develop and maintain an off-leash dog park on public right-of-way located immediately northwest of the intersection of East Lincoln Avenue (grade-level portion) and South Bay Street; and, be it

Further Resolved, That this agreement shall include, but not be limited to, the following provisions:

1. Residents for Off-Leash Milwaukee Parks shall be responsible for maintenance of the off-leash dog park, including the placement and maintenance of fences, signs, lighting and benches, the cutting of weeds and grass, and the removal of litter and animal waste.

2. Residents for Off-Leash Milwaukee Parks shall be liable for any damages to the right-of-way relating to its use as a dog park.

3. Residents for Off-Leash Milwaukee Parks shall pay the City an annual rent of ...
