Title
Resolution permitting a minor modification to the Detailed Planned Development (DPD) known as Humboldt Yards (Commercial Parcel) Phase 1, located on the South Side of West North Avenue and East of North Humboldt Avenue, in the 6th Aldermanic District. (DCD)
Analysis
This resolution will allow for the retail sale of alcohol in the existing Jewel-Osco grocery store.
Body
Whereas, Section 295-814(5) of the Milwaukee Code of Ordinances permits modifications to planned developments after approval of the Common Council; and
Whereas, The change in zoning from a General Planned Development to a Detailed Planned Development known as Humboldt Yards (Commercial Parcel) Phase 1, was approved by the Common Council on May 5, 1998, under File No. 971744 for construction of a commercial building which included approximately 88,000 square feet of retail space and accessory parking; and
Whereas, The first amendment to the detailed plan for a planned development known as Humboldt Yards (Commercial Parcel) Phase 1, was approved by the Common Council on September 24, 2002, under File No. 020653 to allow for the interior build-out and minor modifications to the existing facade facing East North Avenue for the occupancy of a health care facility; and
Whereas, American Store Properties, Inc. is requesting a minor modification to allow for the inclusion of a liquor department within a 3,100 square foot area in the southwest corner of the existing Jewel-Osco grocery store; and
Whereas, On July 16, 2004, the Utilities & Licenses Committee and on July 27, 2004, the Common Council unanimously approved the liquor license; and
Whereas, The proposed liquor sales area is generally consistent with the spirit and intent of the approved detailed plan, will not adversely affect surrounding development and a copy of which is attached to this Common Council File as Exhibit A which is...
