Analysis
This substitute resolution authorizes the Department of Public Works to accept and fund a Stormwater Best Management Practices Construction Criteria grant from the Milwaukee Metropolitan Sewerage District in the amount of $79,160.00 with a city share of $39,580.00 and a grantor share of $39,580.00.  The purpose of the grant is to study infiltration and inflow in two sanitary sewers located adjacent to two previously constructed detention basins.  This resolution also authorizes and directs the proper City Officers to execute an Intergovernmental Cooperation Agreement between the City and the Milwaukee Metropolitan Sewerage District regarding the project grant.
Body
Whereas, The City of Milwaukee(City) is eligible for grant funds from the Milwaukee Metropolitan Sewerage district (MMSD) for a study of infiltration and inflow (I/I) in two sanitary sewers located adjacent to two previously constructed detentions basins; and
 
Whereas, The City currently requires construction permit holders to comply with the City stormwater ordinance (chapter 120); the MMSD stormwater rule (chapter 13), and the Wisconsin Department of Natural Resources Chapter stormwater rule (chapter NR151); and
 
Whereas, The rules require construction and implementation of stormwater best management practices (bmps) to manage the quality and quantity of stormwater runoff; and
 
Whereas, One type of bmp that is often constructed in the City is the detention basin; and
 
Whereas, Detention basins store significant volumes of water; and
 
Whereas, Water stored near sanitary sewers and sanitary laterals has the potential to increase I/I into the sanitary sewer; and
 
Whereas, Excess quantities of I/I cause sanitary sewers to overflow and sanitary water to be bypassed to area rivers and lakes; and
 
Whereas, The City has submitted a proposal to the MMSD in response to their Request for Proposals titled "Construction Criteria for Stormwater Best Management Practices" to study I/I in two sanitary sewers located adjacent to two previously constructed detention basins; and
 
Whereas, MMSD has adopted Resolution File ID#04-135-9 awarding the City with matching grant funds not to exceed $39,580.00 to study I/I in sanitary sewers near detention basins and recommend construction criteria to minimize I/I near detention basins, a copy of said resolution being attached to this file and incorporated in this resolution as though set forth in full; and
 
Whereas, The operation of this grant for the Construction Criteria for Stormwater Best Management Practices from January, 2005 through December, 2005 would cost $79,160.00 of which $39,580.00 (50%) would be provided by the city and $39,580.00 would be provided by the grantor; and
 
Whereas, An Intergovernmental Cooperation Agreement (ICA) between the City and MMSD is required to define the scope and duration of the agreement, the project deliverables, payments and other details required to coordinate the work and complete the project as intended, a copy of said ICA being attached to this file and incorporated in this resolution by reference as though set forth in full; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers and/or the herein named department head are hereby authorized to accept such a grant without further Common Council approval unless the terms of the grant change as indicated in Common Council file 030712 (Grant Ordinance); and, be it
Further Resolved, That the City Comptroller is authorized to:
 
1.      Commit funds within the Project/Grant Parent of the 2005 Special Revenue-Grant and Aid Projects and fund the following amount for the project titled, "Construction Criteria for Stormwater Best Management Practices."

2.      Create the necessary Grant and Aid Project/Grant and Project /Grant Levels; budget against these Project/Grant values the amount required under the grant; and, be it
 
Further Resolved, That these funds are budgeted for the Department of Public Works which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant and incur costs consistent with the grant; and, be it
 
Further Resolved, That the reimbursement amount received from MMSD be deposited in accordance with procedures established by the City Comptroller; and, be it
 
Further Resolved, That Infrastructure Services/Sewer Maintenance commit $39,580 to fund the project titled Milwaukee Metropolitan Sewerage District Stormwater Best Management Practices Construction Criteria grant Program:
