Title
Resolution removing a deed restriction from a former tax-deed, vacant lot formerly known as 2909 North Bremen Street, in the 3rd Aldermanic District.
Analysis
This resolution will remove a deed restriction imposed by the City of Milwaukee that prohibits division of land and construction of a principal building.
Body
Whereas, Pursuant to Common Council File No. 80-620 adopted October 21, 1980, the City of Milwaukee conveyed to Bradley T. Shovers by Quit Claim Deed dated November 24, 1980, a tax-deed, vacant lot at 2909 North Bremen Street that adjoined his property at 2915 North Bremen Street; and

Whereas, The deed of conveyance contained restrictions that "the property herein conveyed shall be joined with the grantee's adjoining property so as to create a single parcel to be used as a unit; that said combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee; and that the land herein conveyed shall be used as open space and no principal building may be erected thereon"; and

Whereas, The combined property was acquired in 2001 by Stephen and Ellen Servais who now desire to build an owner-occupied, single-family home on the vacant portion of their property, but need the deed restriction released to obtain a building permit; and

Whereas, The Department of City Development recommends release of the deed restriction to facilitate this development subject to approval of final site and building plans by the Department of City Development; and

Whereas, The cost for this process is $1,250, less a 20 percent administrative fee paid to the Redevelopment Authority of the City of Milwaukee; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of City Development, or designee, is authorized to execute the necessary legal documents to remove the restriction contained in the deed ...
