Whereas, The Wisconsin Department of Transportation (WISDOT) is currently performing design engineering for the South Leg Marquette Interchange project; and

Whereas, As a part of the Marquette Interchange South Leg project, a freeway overpass shall be constructed over an industrial railroad spur track currently being constructed adjacent to Canal Street by the City; and

Whereas, A portion of the railroad spur shall be owned by the City of Milwaukee and maintained by CP Rail; and

Whereas, The WISDOT has drafted a Stipulation Agreement between the WISDOT, City of Milwaukee, Soo Line Railroad (d.b.a. CP Rail), and St. Mary's Cement regarding construction, cost sharing, right-of-way acquisition, maintenance, and other provisions associated with construction of the overpass; and

Whereas, The stipulation agreement specifies that costs for overpass construction shall not accrue to the City; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are authorized to execute the stipulation agreement between the WISDOT, City of Milwaukee, Soo Line Railroad (d.b.a.
